LL dictating specific Contractors

    we insist that we pre-agree the use of any specialist cleaners – particularly carpet cleaners. It is essential that process is carried out properly as the use of incorrect machinery or high-soap or harsh chemicals can inflict lasting damage. If you use your own contractor we cannot be sure that our property is being correctly treated. That is uppermost in our mind and is an obligation placed upon you under the tenancy agreement. In addition we will not be bound to accept work done where we have not been consulted in advance, and given our agreement.


    So we have tried calling our LL didn't answer, never does avoids talking to us and alway communicated to us through email. So we've dropped him an email stating his preferred Contracts need more notice and can't do it before the end of our Tenancy and we will be using our prefereed company and sent him the details.

    But really does he have to agree who we use?

    The LL is trying it on and your naivety is getting the better of you.....

    All the information you need is in this thread, put your mind at rest use your own cleaners and take plenty of digital pictures just before you go. No need to print them off just leave them on your phone/camera until the deposit has been returned.

    If the LL raises a dispute and attempts to withhold deposit you will get plenty of further advice here.

    However, if your contractors do actually damage the carpets you would be liable. Of course, given that you have used them before, and it doesn't sound like the carpets are particularly unusual, then I doubt there would be any problems.

    Is this correct? Surely the contractors are the ones that are liable if they do any damage. Any professional company will have insurance to cover this kind of situation so any issue should be directed to them if the LL complains. At least if it is another company doing the cleaning then you also have their word for the condition should any dispute arise for the deposit.

    It is probably a previous tenant getting this wrong ad fobbing the Landlord off direct to the contractor which has brought about the LL's demands on OP

    I believe that, under Contract Law, this would have to be the case - as the LL doesn't have a contract with the contractor to take it up with them directly.

    OP - your rights and obligations have been explained within the thread above.

    My advice is
    * do NOT communicate further with the LL. Ignore his letters.
    * do NOT engage in a "you must ... "/ " Why can't I ...." dialogue.
    * clean the place before you leave. Use your own contractors if you want,or DIY.
    * take photos.

    If the LL tries to keep your deposit, dispute this. You do not say if the deposit is registered with a recognised scheme: is it? Which one? You can check with each of the 3 Deposits schemes yourself.

    If it is registered, use their dispute process - you will win.
    If it is not registered, use the small claims court- you will win.

    Relax. You don't need a reference seeing as you have bought a home, so you should be fine......

    The OP says their tenancy ends in 10 days, so I'm guessing they've passed this part of the process.

    As post above. OP has already exchanged on the property they are buying.

    When lenders seek references from LLs they query whether or not the rent has always been paid in full and on time, not whether there is a dispute over end of tenancy cleaning.

    We don't need a reference as we've bought a property.

    Deposit is lodged with My Deposits so is protected.
    Turning our clutter to top up our house deposit: £3000/£303.05 we're on our way!

    I guess this has already been explained, but yes you would be liable to the landlord, and the contractors would be liable to you.
