DLA Claim Appeal

I've suffered from severe lower back problems since October last year. The usual things disc bulge with nerve compression, three levels of degenerated discs, herniation etc. I believe I've had most of the problems for around 10 years but it seems my time ran out.

I'm on morphine, pregablin etc and have had five facet injections with private and pain clinic physio. Surgery has been ruled out as a viable option at this time. My pain levels are still very high, walking ability is very limited, bending is not possible and I am being treated for depression and stress probably mainly due to the pain.

My claim was rejected outright on first pass.
Reconsideration after GP letter of support was; Although walking is limited, not unable or virtually unable to walk. Although I have difficulty with care I don't need help sufficient for an award.
Appeal papers received; surprised to see no consultant comments, just a letter stating medicine and MRI scans provided.

I contacted my consultant to see if he would support me and received a letter back stating "I am unable to provide any letter to support your appeal as people with your condition are able to work in the community".

I found this quite confusing, as I am still registered as a full time employee with my company and applying for a transfer to a local office on reduced hours. But this is by the by as I don't have the energy or hair left to try and debate DLA with his secretary.

My question is with my GP backing my appeal but not my consultant should I continue?

Friends and family are all for it but I just feel it could be another 6 months of stress and possible disappointment.

    You can work and get DLA though, so ask your consultant again to confirm your disability, not his view on whether you can work or not!

    Sounds like your consultant or understudy is confused about the difference of ESA and DLA because DLA is not an out of work benefit. I would contact them and make this clear although the consultant is under no obligation to provide anything.

    My DLA was awarded after the DWP consulted my GP and physio, they didn't contact my consultant(s).
