    How about nearly 10 months and counting? Just my luck to be hit by a driver insured by them.

    However, It seems the various companies involved on "my side" are being just as bad. As far as I can tell nothing is happening at all. If it is, I've been given zero indication of it.

    Do claims of this nature often just get dropped and remain forever unresolved?

    Your old insurers should get their money back, but they are just incapable of finding their !!!! with both hands. So it will just drag on.

    Your insurers should just get onto the other side and make sure they have the documentary evidence to support their outlay and give them 14 days to cough or commence proceedings. It really is as simple as that.

    I never lost it, it was waived due to the clear no blame nature of the accident.

    You'd think. They've handed the whole thing over to solicitors who wrote to me to tell me they did exactly that. But that was months ago and I've heard nothing more about it since.

    The insurers don't know what's happening other than the fact that they still haven't got their money back and have asked the solicitors to deal with it. They seem to have washed their hands of the whole thing and just refer me to the solicitors. The solicitors are completely uncontactable.

    If anyone has any ideas on how I can get things moving, or even just find out what (if anything) is happening, I'd be very grateful!

    Horwich Farrelly. I waited until today to post because I thought I'd give everyone involved another chance first, but still no contact from them. They just never answer the phone, never respond to voicemail messages and never reply to emails.

    Of course, I have no idea what's involved in this whole process. How long would it normally take to "issue proceedings"? More than four months?
  • Providing the solicitors have the documentary evidence to support the insurers outlay and also have served the other side with a letter saying they are going to commence proceedings (usually 14 days notice), that is all that needs to be done.

    They can issue the proceedings by sending the county court claim forms and issue fee to Northampton County Court and that's it, proceedings under way.

    On the face of it, there's no good reason why this hasn't happened already.

    You should have heard from Horwich Farrelly as they should write to you and check you have no uninsured losses outstanding before they issue the proceedings as the court proceedings for your insurers outlay will actually be in your name and if you were still owed money for some other losses and they don't give you a chance to include them, they prejudice your position.

    It doesn't take 4 months to issue proceedings, but can take much longer than that between the date of issue and the conclusion of the matter

    I did have to fill in a form detailing my uninsured losses when I first received their letter stating they had given the third party 14 days to pay. That was 6 months after the accident and about 4 months have passed since then. Since I can't find out from anyone what's going on, I guess I'll just have to hope that proceedings are, well, proceeding...

    But I still can't believe how long this is all taking.

  • Well a small claims matter should get to an assessment of damages hearing within 3-4 months as this is a claim where liability is admitted.

    Either the solicitors have not yet even issued the proceedings or the other side are disputing the financial value of the claim.
