Barclaycard - some advice please on what to do....

    I would photocopy all of your statements ref this. Then go to the companies house website, and get the name of the CEO of Barclays. I would then send him a copyd of all of this via special delivery, and at the bottom of the letter of complaint, cc it to the MoneyMail page at the Daily Mail, or the equivalent in your other favourite paper. And send them the same stuff.

    CEO's don't like adverse publicity. Other than that I would still suggest you talk to the CAB, not about the debt, but about whether Barclays are allowed to do this. They may suggest a stratagy other than that above, that will help you stop this merry go round of charges you are on

    Excellent advice Chev, thank you, I would never have thought of this but I think I'll give this a go. We are paying it anyway so another few letters that might help would be great. Thanks for your time in posting, much appreciated.

    Hope you get it sorted stuckhere - I think each of us has a different creditor they find the worst to deal with - Hubby's has to be MBNA - they are so up their own backsides it is unreal - mine on the other hand is Natwest/Capquest - we had a joint loan and overdraft with them - the monthly payments are going out of hubby's account and they have left him alone - however they starting ringing me with the threats and the sarcasm - turned out that Natwest had passed the debt over as 2 single debts so instead of the already bad enough £14k - they wanted £28k !!!

    Barclays Masterloan accepted my reduced payment offer & froze interest virtually by return of post. Barclaycard on the other hand just seem to be ignoring me! I've now set up a standing order to pay them the amount offered and written (yet again) to them I've done this.
    MBNA - had to do the same with them.
    Lloyds-TSB - had to cc my letters to OFT, Banking Ombudsman & consumer section of the Guardian & Indi before they responded to me.
    Sometimes it's like a bizzare game - still, my local post office is being kept going by me so at least someones winning!

    my barclaycard ran into arrears. my limit was £3500 but missed a payment. each month a hundred pounds was added until it got to over £4000.

    they passed my debt onto mercers debt colection and they just pester me no-end! letters, phone calls and even text messages. their number comes up unknown and i never answer it. i correspond through letter only. i have told them this and threated THEM with harrasment if they keep doing it. haven't heard from them for a while. maybe they have accepted my offer?

  • Does anyone know how far a bank can legally go with theis small print that says they can take money frm any account to pay off any debt?? The reason I ask is on Friday:

    Barclaycard took £2500 directly out of my Barclays current account without asking or informing me. There is no DD set up, I have tried to make an arrangement with Barclaycard - I offered £90 a month to pay off a £3000 debt - it was actually more than my minimum payment was. They said they wouldn't accept less than £370 a month which was ridiculous considering I was unemployed and suffering with Cancer.

    I have just leterally in the last few weeks got back onto my feet and was paid some money by my new emploer for expenses on a business trip next week. Now they have totally cleared out my account and left me £200 overdrawn. I'm going to get arrested for theft when I explain to my new emplyer that I don't have their money any more. Also I haven't got a single penny to live on so at the end of the week I will be evicted for not being able to pay my rent.

    If you want my advice - close any accounts you have with Barclays even if it means having to live without access to a current account. That a bank can call this reasonable behaviour is ridiculous!!

  • Bimbler - yes they can - HSBC are doing the same to me i cancelled my loan payments and offered a lower amount thy refused took the money and sent me overdrawn, i then set up a standing order to pay the loan when i got back into work - i tried to cancel it a few weeks later asi had gotten the date wrong - they wrote to me refusing

    thier now on my back 24-7 if i go a penny over , i really wish i could get another account but with not havign a job at the minute im stuffed


    I m havign trouble with barclaycard too, i send a small by bacs every month and have had a statemnt up until this month so whether its been apssed over i dont know as Ive had no letters, barlcayloan have as said been good and forzen insterest etc.

    Cahoot are terrible they ignore my emails and letters or they keep emaling me asking to ring them, they have refused my payments so i eventually set up a bacs to both accounts and then i got letters which confused the heck out of me

    It started of by saying it defaulted then that they may pass it on to another agency then that i should apply to the courts now to see what to do!
    Its worse when your ignored.
    My OH has a barclay CC and they have ignored him every time even if he calls up they say thier system is down and to ring later! hes now after 2 years got a CCJ from them

    Also why is companies refuse to deal with you unles you go through cccs etc - its just the same you could stop paying them as much as you could stop paying the creditor themselves

    non of it makes sense

  • I've kept my bank accounts with barclays in good order and have even got to the point of paying back my overdraft. I don't see how they can legally do this - even if there is small print to say they can do it surely there must be some kind of regulation on it. Otherwise barclays could just take money out of your account as and when they feel like it??? And the amount has also got to be illegal - they didn't inform me of it and it has left me with absolutely no money - the amount they took is practically 90% of what I owed on my card! As far as I can see they are trying to get around it by NOT taking me to court or issuing a judgement. That way you don't get the luxury of a court deciding on what is a fair minimum payment! If they don;t want to pay the money back to me and take a reasonable amount as I have previously offered then I'm taking this to the national press - Barclaycard put cancer suffer out on the streets - even though he was rapidly paying off his debts!

    reading your story makes me more convinced that barclaycard are literally SCUM.

    I had a bcard and i set up a DD for the min payment on payday, then overpaid with ebay etc money through the month. Amazingly, I could not make this payment over the phone, only in cash at a barclays branch! WHAT!! Isnt it really something that they can take YOUR money whenever they feel like it, but they are not able to accept ad hoc payments when I was trying to clear debt. I would NEVER touch them again, NEVER.

    yes, they can do it tho .I suggest following chevs advice.

  • It would be interesting to find out where the invisible line exists between Barclaycard rejecting your payments and then just taking however much money they feel like - I mean that just goes completely against any kind of negotiation or arbitration. They don't appear to have been granted power by any court. Also, what happens if Barclays aquire one of your other lenders - can they just rape your accounts on the same day?

    I wouldn't be so angry but my current account is in good order - I even have a £1200 overdraft that I don't use. Even more ridiculous is the fact that I can instantly cash a cheque for up to £1000 without it clearing for being a good customer!?!?

    Tomorrow I intend to go insist on seeing the local manager at my Barclays branch and see if he is going to do anything about it - at the end of the day it's his bank that have allowed Barclaycard to take the money. I know for a fact that your bank can reverse any card payment within 4 days if it is under question.
