unsecured load...what are the charges?

Hi after a bit of advice.... to cut a long story short my husband was driving home from work, with 2 small pieces of wood secured on top of his van... one piece came loose and caused a crack in the windscreen of car travelling behind.... husband stopped and apologised to the driver.. gave him his insurance and contact details asked if he wanted him to call police other driver said no it would be fine he would just get it fixed and contact husbands insurance

fast forward 6 weeks.... the police have just been at the door regarding the incident.... is my hubby likely to be charged with leaving scene failing to report accident along with dangerous driving????

incidently just after it happened husband had no end of calls from the other driver stating he had to call his insurance and hurry them up as car was still in garage 3 days later... husband asked why car was in garage and other driver stated there was damage to bonnet, windscreen and roof of the car.... and the whole frame for windscreen needed replacing... as far as my husband was aware there was relatively minor damage however called his insurance and requested they try speed up the claim... thats last we have heard any thing about it until today when police are at door....

    Why didn't you just ask the police that? Seems unlikely to me that your husband would be charged as I think you only need to report an accident if there is injury or you do not give your details to the other person; but how can anyone else say with any degree of certainty? It's a pity the police don't have something better to do than harass motorists. The thing is it's an easy one for the police to get their statistics up and motorists are a soft target. I know of someone who was told by the police he probably wouldn't be charged and then promptly was; lost his job over it !

    I didnt ask as he isnt here he is at work, they said they would be back later I did ask what it was regarding and they said an accident that happened 4th May I said the piece of wood from van they said yes that was it....suppose will have to wait till later to see what they say ..... kinda worried tho :(

    He has fulfilled his obligations at roadside, it will be the other driver hassling the police, hubby has a right to silence I suggest he uses it with the police.

  • If he has fulfilled his obligations that puts my mind at rest slightly ty x I was concerned on the day it happened that the police werent called as I had assumed ANY accident they should be called, to know thats not the case is reassuring...

    unsure now why the other driver would have called the police after all this time ... is obvious they have husbands details etc as they have given them to police.... husband did say at the time of the call re the garage that they were at it as he had seen the damage and it was a small crack to windscreen, so unless insurance arent paying out am not sure.......

    Did the police actually say that your husband is under investigation?

    From everything you've said, I would think it's the other guy that's being investigated for attempted insurance fraud, and they want to speak to your husband is a witness.
  • Well hes been charged under section 1.7??. Of the road traffic act Police read his rights etc he actually went to the station on way home rather than them coming here ...insurance called him today also to state they will not be re insuring due to ongoing claim ... This guy is apparently STILL running around in a hire car !!! complete farce !!! The police have said not to worry it may not get to court however u never know with these things...insurance also stated they dont understand why its been taken this far as far as they could make out its a straight replacement windscreen and they woul have expected my husband to have paid the excess and thats it they also querying why so excessive. Really have nothing against people from other countries in uk however ........ The gentleman in question wasnt originally from uk!!

    To be honest i think hes not that clear himself .... Carrying an unsecure load he stated to me has no paper work etc police said he was not at fault for not calling them at the time and he was correct in supplying his insurance info etc they said it was very unfortunate that other driver reported and requested action as they legally have to follow it up

    He has to phone insurance tomorrow as was up to eyes in it at work at the time they initially called, am presuming they have not fully paid out claim given the info she did say to him over the phone and wonder whether this is the reason as to why he has only now contacted the police ...... the police also said something on the lines of ( he cant quite remember exact wording) it may be thrown out by procurator fiscal or it may be that some kind of arrangement is made???!!?? we take this to mean other driver may be seeking some kind of compensation also??
