Structural Building Warranty

Hi

I have exchanged contracts on a new build property and we were supposed to complete Monday just past. However this did not happen because I find out that the builder has laid ceramic tiles directly onto 22mm weyroc flooring in all upstairs bathrooms using fast flex tile adhesive. The buildings structural warranty provider have frowned upon this and said a plywood base should have been fitted, so will not issue their guarantee.

To get round this problem and prevent the floors being relaid correctly and not delay completion the builder has loose laid cheap vinyl flooring over these tiles taken a photograph and sent to the warranty provider, who in turn have said this is now acceptable and have issued the certificate knowing that the tiles are still in situ.

Because I chose these floor tiles having been given the choice to select ceramic tiles by the builder, and will be paying for them upon completion, and having been told by the builder after completion that the vinyl can be lifted up and removed, what happens to the warranty? My concern will be that by reverting back to the original tiles then the warranty becomes void! Otherwise surely it would have been accepted in the very first place and completion would not be delayed while we verify the validity of this warranty.

    As expected Premier Guarantee have come back and said that if the vinyl is lifted exposing the ceramic tiles then the warranty will be invalid for this flooring and I lose any guarantee on 3 bathroom floors.

    Are you doing the conveyancing yourself or using a solicitor?

    If yourself, I advise you not to, as you appear not to know how to deal with this dispute.

    If a solicitor, I suggest you consult him/her regarding the breach of contract and/or loss of warranty.

    Hi

    Have been using solicitor all along but to no avail, unfortunately this took 4 days to determine I would void warranty but we cannot verify if it's a breach of contract. We were threatened with litigation and failure to complete so have completed. I feel very aggrieved over the matter but we can't find anyway to solve this.
