    Ahhhh to go through Churchill or claim directly off the third party insurers? Different advice.

    Will Churchill make me pay the excess prior to the decision of who's fault it is? What would really 'P' me off would be to pay the excess, with the thinking that I will get my excess back eventually, and then Churchill hitting me with 50/50 or something else.

    Blimin' annoying though, that even when not at fault, you have to be out of pocket for such a long time!!

    Your excess isn't covered by your policy - it's an uninsured loss that would normally have to be paid to the garage on collection of the car. You then claim it off the third party (in your case you can get your legal cover to claim it for you).

    (Alternatively, Churchill may pass you on to a claim handler, in which case no excess to pay)

    When you say claims handler, who is this? (Apologies for my lack of knowledge on this matter)

    Google claim handlers to learn how they operate. Basically once they know you are blameless, then they will take over your claim for you, arrange a replacement car, and get your car repaired all with no outlay by you.

    My advice if clearly not at fault would be to always claim of the third party's insurer if possible, failing that try an accident management co but make sure you're aware of how they operate, and if all else fails then use your own insurer.
