My situation. We got bought out last year by another company, nothing changed except the owners. We have been told recently that we are being relocated to another part of the country, we will
all be made redundant ( after consultation process etc etc ).

The company who bought us own another company in the same sector and will be moving our distribution to their distribution centre. We will be employed by the other company.

My question, as I am struggling to get any definite answers through consultation, will my terms and conditions be protected through TUPE if I take one of the jobs at the new distribution centre.

I have been employed here for 30 years now so do not wish to lose my service length as I would be forfeiting my redundancy if I take on a new position.

    If your company has been bought by the other then you are either still employed by the original company as it still exists or they can transfer you but it will still be continuous employment.

    You need to ask. A new job is the only legitimate way to remove TUPE protection so if you are successful in your application for a job at the new distribution centre and offered the job it may well be on your employers standard terms and conditions. The only thing that will always be protected is your continuous service date (assuming you have left at any stage). How different are the terms? You may find they are very similar and getting the new job is better than being made redundant.
