UK CPS Parking Ticket!

Hi,

I received a parking ticket from UKCPS a couple of weeks ago, for parking at an office complex where I was on training for work. I did what I thought was the most sensible thing and appealed via email (which after looking on here seems to be a pointless thing to do) saying I didnt think the parking notice was justified etc and wanted it to be revoked.
I have received a reply today to say that the notice stands, and that I was observed by the warden walking off site away from my car towards the job centre (which as far as I am aware there isnt a job centre anywhere nearby!) ...which has made me more cross and wanting to reply to say they are wrong!

On UKCPS website they go to great pains to give examples of court papers and say that websites like this are wrong in saying that these things arent enforceable so I am really unsure what to do...its all very well saying to ignore this...but court summons and solicitors letters dropping through the door sound a little frightening. If its not enforceable how do they get away with it??? :mad:

    You can ignore peter haswell the little weasel of an office manager.

    Dont worr about them taking you to court. They failed to tell you of the importance of a recent court ruling ( hmrc vs vcs)

    The appeal tribunal held:

    1. VCS did not have any right to occupy land or to pursue any action in trespass (which is what VCS had claimed they were doing).
    2. Such payments they received by way of "Parking Charge Notices" were not therefore a payment by way of damages and were not therefore exempt from VAT.
    3. That on the basis of their standard agreement with landowners there could have been no contract formed between VCS and the motorist because its limited rights to access to the land did not extend to being able to offer the right to park.
    4. The signs used by VCS cannot have effect because they have no right in law to make any offer to park in the first instance.
    5. Any contract to park could only be formed between the landowner and the motorist
    6. Any parking charges collected by VCS would therefore be, in effective, damages in breach of contract or trespass but because they were retained by VCS they constituted a standard-rated consideration and VAT was therefore payable against them.

  • Because the judgements they have won have been either uncontested (because they conveniently arrange for the papers to be served to old addresses ), or they arent related to parking ,or they are very very old. Every single one of the uncontested ones could have been set aside, reheard and defeated.

    Its all part of the very clever Impersonation of Authority Fraud they operate. However, make no mistake they havent a leg to stand on. There invoices (not 'ticket's) are unenforceable, as recently confirmed in a recent court case (VCS vs HMCR), which ruled that private parking companies have no authority to offer parking on land they dont own, nor pursue motorists for penalty charges.

    So ignore them, its unenforceable rubbish. UKCPS 'patrol' the car park of the block of flats where my son lives, I have about nine tickets from them now, I have ignored them all, and got the usual chain of toothless threatograms.

    Nothing will happen, If its enforceable in court how come they dont pursue me more vigorously? The answer is, they know they will lose. Its an unsolicited invoice for an illegal penalty you didnt agree to, on a contract you never agreed to enter.

    Relax, ignore them. If you want, just write F*CK OFF in large black letters on their letter and send it back in an unstamped envelope. They'll get the hint.

    molly,the court ruling??? doesnt really matter as they dont agree with scam merchants either, now relax, nout will/can happen as a result of this,,and the threat o grams you will recieve, just keep em as spare loo paper when you run out.jobs a good un then.dont worry about their empty threats as we know like them and now you if they ever did court they would simply, get spanked.

    The same way I can charge you £50 for your post-will you pay me if I threaten you? I can be really nasty if you want....

    No its easy.

    imagine a small thin spotty 12 year old with handkerchief over his face, holding a very small blunt penknife and demanding you hand over your purse.

    Now what would you do?
