Private parking charge £120 - I was a genuine Holiday Inn customer!

Should I go to the hotel company (not the parking charge issuing company - ParkingEye) and tell them that I was using their facilities and therefore charging me this penalty is unfair

The reason I ask is that if I speak to them about how I was at the premises I am essentially admitting that I was the driver of the offending vehicle, something my research tells me I dont want to do

My research also tells me to ignore the letters!!! which I fully intend to do!

Im pretty confident I dont need to worry about a thing from researching this on the internet as its not a fine, what I really want though is to go to the hotel and communicate my greif to a manager there, in doing so am I destroying any case for non payment?

I was attending a wedding, it entered the car park at 21:14 and left at 22:40 on a Saturday night. It was dark so the signage didnt exactly jump out at me and it didnt even occur to me that I would have to pay for a Hotel car park even as a guest! 1hr 25m and I get a £120 fine, even though I was using the Hotel, tell me that isnt a disgrace!

Hence, I wanna go make a complaint (simply out of principle). I have a photograph (from facebook) with the groom proving I was at his wedding and I am sure I can dig out the invitation. I also spent about £30 behind the bar (which I cant prove). Im just worried if I make a formal complaint with the hotel, but ignore the letters I am digging myself a hole that will cause me more aggro than its worth

I'm not going to pay it, but causing a scene in front of guests (its an up-market Holiday Inn) will make me feel LOADS better

P.S. - I am aware there is a 99.9% I should even be worried about this but - Is there a period for me to settle the amount between receiving CCJ docs officially from the court and actually having them enforced? Im applying for my first mortgage so I wanna know the risk against my credit rating - Ill settle if it means not damaging my credit

P.P.S. - Martin Lewis is a legend!

Parking Eye haven't done anything to Mrs theHibby other than give her 3 pieces of toilet paper on each of the occasions she has broken their legally non-binding rules.

Don't waste your time on this mob and ignore the scam letters.

They can't do court because of a recent ruling so they can't touch your credit rating any more than I can if you don't pay me £120 for this advice.

No. The only plan is ignore, ignore ignore. Its all unenforceable illegal rubbish. You have more chance of playing croquet naked with Liz Hurley on Buckingham Palace lawn than it ending up in court

  • Thanks for your thoughts :D

I work nearby so I am going to go down and have a look at the signage just to get an idea of exactly why this has happened and if I need to be more careful, I just wanted to pop in and give them an earful because I find the charge insulting

Whatever happens I aint paying them a penny

I believe the words 'penalty charge notice' mean something legally, anything else is crap especially if it uses similar words in an attempt to appear legally binding.
'Parking charge notice' is the 'normal' manner in which these private cowboys attempt to extort.

I have the same from the same company for parking in an empty shopping centre cp between 21.30 and 1.19 am : no danger of any loss to PEs 'clients' since none of them were open nor likely ever to be at that time, hence they had no 'losses' and since the 1st 2 hours were free in any case they couldn't prove what the additional 90 minutes were worth in any case.
IGNORE IGNORE IGNORE but keep the paperwork anyway
Unless specifically stated all posts by me are my own considered opinion.
