- be 16 years or older;
- be resident in the UK;
- have a valid television licence;
- have an internet connection;
- have an aerial capable of receiving Freeview programming; and
- agree to the terms and conditions of the YouView service, as notified to you from time to time.
It is essential that you keep information relating to your participation in the Trial confidential. In particular, you must not:
- disclose to anyone else any information, experience, images, content or details relating to your participation in the Trial;
- publish any comments and/or still or moving images in or on any media (including on the internet or on any blogs or social networking sites), relating to your YouView Box or the Trial;
- take or share any still or moving images of your YouView Box, the YouView user interface or of any other materials provided to you or via the YouView Box in connection with the Trial;
- share your login details to the YouView Trials website with anyone else; or
- allow anyone else, other than the people you live with, to use your YouView Box or to view any materials provided to you in connection with the Trial.

So rather than just be honest and say a TV Licence isn't required they've put it in making sure people who don't need one will think they do, that's just plain wrong and very underhand0 -
It's likely that as part of this trial, you'll have to test both the catch-up and live TV aspects of the proposed set-top-box they provide. 17. RETURNING THE BOX TO US AND OTHER OBLIGATIONS
At the end of your participation in the Trial, or otherwise upon request from us, you must:
immediately stop using your YouView Box and any other items provided to you in connection with the Trial (including, without limitation, the remote control, cabling and associated materials);
make the YouView Box and any other items provided to you in connection with the Trial (including, without limitation the remote control, cabling and associated materials) available for collection; and/or
return the YouView Box and any other items provided to you in connection with the Trial (including, without limitation the remote control, cabling and associated materials) to the designated location notified to you at the time.

It is not wrong or underhand and has nothing to do with not needing one for catch-up Tv. If they say in the terms and conditions a TV licence is required to take part in the trial then a TV licence is required.0 -
As the unit has a DVB tuner and can receive live tv as a primary function you would need a tv licence regardless of if you watch live tv or not. I'd imagine the unit would have to be tuned in to operate properly anyway.0
