Rent rebate due to disrepair

Hi all,

Very new to all of this so apologies if this has perhaps been brought up in the past, we have just moved out of our previous (rented) home. We have had no end of problems, which resulted in the council coming to the home and carrying out an inspection - the LL did not carry out the majority of points that the housing inspector told him to do (some of which were dangerous) so we vacated the property 11 days prior to the end of the lease (but still paid the rent) - I have heard that we can try and claim the rent back for this due to the disrepair but don't know how to go about this - are there any templates for this kind of thing? Sorry if this is not enough details but was unsure as to what to write!!! Thanks so much in advance!!!!!!! As we had to move out so quickly, we are totally skint so anythign we can get back woudl be brill!!! Matt

    You can't.

    If, however, by the 'council inspector' you mean the Environmental Health officer, then they could in theory prosecute him for not meeting legally-binding repairing orders. Although now you are out they may well not bother.

    Can I claim back some of my rent?

    If you haven't been able to use your home, or part of it because of the disrepair, you may be entitled to a reduction or refund of rent – this is called an ‘abatement of rent’. You may be able to claim for inconvenience and disrepair, and the amount you can claim will depend on how much of your home is uninhabitable. If no part of the house can be used, 100 per cent of the rent may be reduced/refunded. If only part of the house is unusable then the rent will be reduced proportionally.

    We moved out 11 days early due to it being unsafe, therefore - I woudl assume the bottom paragraph applies but I am not sure how to word the letter/claim. Matt

    The Envionmental Health report should have stated the category of the hazards found, and therefore if the house was uninhabitable.

    Should you have paid for alternative accommodation, then you may be able to reclaim these costs from the LL, but be prepared for a fight!
