car purchase-private sale

long story short, my son sold a car for £650 private sale.

he was paid £300 cash and £350 wired to his account, the guy showed him the confirmation of the wire transfer from his account, he wrote receipt out (stupidly never checked his account) for the £650 and has now discovered the money has not went through, he's called the guy but he says nothing he can do, he has receipt so is this pretty much a harsh lesson?
has he lost his £350?

Does the receipt say how payment was made?

What confirmation was shown to him? Sometimes wire transfers can take several days to hit the recipients account.

I fear he has very few options unfortunately. If he knows where the guy lives then take a visit perhaps? (I trust he got the details when selling the car to put on the V5 form..)

I trust you also have a signed copy stating amount and payment method?

If so it should be a straight forward case.. you file a claim for non-payment, present the receipt, the defendant can then submit a defense and prove that payment has been made.

Try sending the guy a letter telling him is money isn't forthcoming you will happily pursue him via the courts.

How did you find the buyer? Is there any way of finding his address? If not I believe you can do a search with the DVLA to find the registered keeper of a vehicle.

He's kinda opened himself up to abuse tbh, you could claim he didn't pay any cash and present the signed receiving confirming payment method ---- not that I would condone this :D

You mean he handed over the car on the basis of something on the guy's phone??

report the car as stolen, the police love ANPR gadgets.
If he has obtained it by deception, its stolen, receipt or no receipt.
The police will pull and seize the car, let him beg for his £350 back which he wont get as it will be pound fees and see how he likes the boot on the other foot.

The guy has the log book and a receipt, I doubt the police would see it as theft or fraud.

You're find the buyer will show the police the receipt, the new v5 in his name. and the seller will find he will be getting a visit.

Find out his address and pay him a visit.

Once at his door, you'll know exactly where you stand within minutes!
