Private Renting Swap ?

Hey just a quick question....

I currently live in a private rented house....

Was wondering if I could find a friend or family who could take over the remaining amount on my lease would I be able to move out?

Therefore the estate agent could switch the name on the lease or ?

Or if I could find someone who wanted my house and I wanted theres could I do a swap where they take on my lease and I take on theirs?

Situation has arisen where it would be more viable for me to live elsewhere for work , if this is something that I cannot do I have until September which isnt too long too wait before I can move.

Just wanted to know if this possible ! Thanks

    Depends entirely on your landlord and those of a prospective swap.

    Technically, yes, but you have a lot to take into consideration (referencing etc)

    There are two ways someone can take over your tenancy:

    1) Early Surrender of the tenancy, with the landlord's consent, and creation by the landlord of a new tenancy in the new tenant's name

    2) You, the landlord and the new tenant all sign a 'Deed of Variation' whereby the new tenant's name is substituted for yours on the existing tenancy.

    As you can see, in either case, the landlord must agree. It is up to the LL whether the new proposed tenant is acceptable to him.

    Indeed: However it rather depends on what your tenancy agreement says on the matter: Most will prohibit such swaps or prohibit without LL's permission.

    e.g. my most recent let had this in it..
    11.3
    SUBLETTING & LODGERS
    The Tenant agrees not to:
    i. assign this tenancy to any other person; or
    ii. sublet the accommodation in whole or in part; or
    iii. take in lodgers or paying guests; or
    iv. allow other persons to share the occupation of the premises, whether or not for payment,
    without the prior written consent of the Landlord.

    in either case, the landlord must agree. It is up to the LL whether the new proposed tenant is acceptable to him.

    Indeed, even if the tenancy prohibited it completely (ie no "without the LL's permission") there is still nothing stopping a LL and tenant agreeing to ignore that clause.

    I may be wrong, but I read Artful's post as simply being a direct response to the OP, without necessarily having noted other respond posts. We all do that from time to time.
