Help needed

Hi,

A few months ago my credit card was credited with £750 mysteriously. I didn't spend it but recently have dipped into the funds. Today I received a letter stating it was an error by the HSBC and they are now wanting the money back from my credit card company who will take the funds out of my account in 5 days.

Can they do this? The error was in HSBC and not mine.

    Short answer, yes they can, however as its there mistake they shouldnt expect you to pay it all back in one go if you cant afford it.

    Shouldnt have spent any of it in first place though really.

    I've seen a number of posts in these forums saying the poster has had funds unexpectedly added to their accounts and asking whether they can spend the money.

    Your post shows that the finance people do track these things down, even after months, and that you have to pay it back. (We knew that, but this is an example of it happening.)

  • What if you had accidentally sent £750 to someone else's credit card by accident - wouldn't you want it back? Even if they had naively spent it already?

    Yes, banks can screw us over, but everybody makes mistakes... contact HSBC and offer them a certain amount for however many months to pay it back. You knew that money wasn't yours to spend...

    This happened to me in 1985...They put the money in and I queried it and they said it was mine.... It was about 540 pounds then so may be a few grand now. So I spent it and then the Bank took the money back.
    A Barrister friend said I should write in quoting some sort of Latin phrase (not sure what it was but it seemed to say that i acted in good faith it was mine). I then got the name of the Chairman of the Bank, Lord so and so and wrote to him. I said I would buy shares in the Bank and raise it at the Shareholders Meeting. They gave me the money in the end...
