    no wasnt mr shah tut tut dealer just because we sent you down and yes i have had 2 heartattacks but it wasnt watching bolton and no kids and no bypass and defo no nappies ill leave them for you and ur fellow surporters

    FRAUDSTER Keith Taylor pocketed £42,421 in incapacity benefit...Taylor is in poor health with conditions including type two diabetes and chronic lymphocytic leukaemia...Taylor did not tell the authorities about his part-time job, because he was paying tax and national insurance and thought those who needed to know would know..Robert Smith, mitigating, urged Judge Tonking to suspend any prison sentence...But the judge said it would be "wrong in principle" to suspend the sentence.

    Can you talk through your situation with Shelter? They will give you advice on your potential homelessness.

    I am all for people being made examples of, but you do also need some advice to help you deal with the consequences of your actions. I hope others withe more experience will be able to help you with that.

    Trolls pick through stories in the media then come onto forums like this to cause a stir. It wouldn't be the real Keith unless he could prove it by uploading a photo right now of himself with a placard saying MSE benefit troll :D

    Yes, it appears that the DWP is happy to use the Proceeds of Crime Act to recovery money from those convicted of benefit fraud. It looks as if the DWP likes using POCA because they can recover an "amount equal to the defendant’s benefit from the conduct concerned" which may well be greater than the sum actually defrauded in the first place.

    As to how you'd defend a POCA application, I don't know. There doesn't appear to be any obvious 'get-out' clauses: if you've committed a crime and received a benefit therefrom, a court can force you to hand it over - the only debate is over the quantum of that benefit.
