This won't go to Court.
Some confusing stuff posted on here. However, in summary:
- SoGA does indeed apply in all material respects to consumers and business purchases. In B2B transactions, certain aspects of SoGA can be contracted out of if "reasonable".
- It is completely wrong to say that Makro sells only to businesses. If a purchaser is a consumer as a matter of fact and law, then absolutely nothing Makro says (or which has been signed up to) can disapply that.
- The confusion here is that SoGA provides rights against the retailer. Indesit is the manufacturer. Makro should, in theory, be joined in to any action by the OP.0 -
Ok, just thought I would post back my results. After speacking multiple bemused managers at Macro it was decided that the address that they were sending the copy invoices to was my (10 years ago) previous business address. hmm. I have changed my address with them I am sure, I deffinatelyt get all their junk mail! but aparently I needed to do more than that, I sucessfully changed my details that took a couple of weeks, then I recieved the copy reciept. To my shock and luck really the thing was fixed within 1 year (BY 2 DAYS), they were happy with that. All over and done with thank god!!0
