Default with "everything everywhere" (orange), removal of....

  • Hi all - i am new to all of this - so if anyone has any adivce I would be very grateful!

    My current situation is as follows:

    I had two default notices on my credit file but have managedto get one removed. J

    The other I have is an old account with Barclays. They haveplaced a default on my credit record for £85.00. However, I paid a lump sum ofthe debt to them at one point and the debt company dealing with this said thatwould be it – debt cleared (which amounted to £84.00 not £85.00 which was wiped).

    After checking my credit report they have not wiped it – nordid they send me any correspondence asking me for the money or making me awarethat a default was to be placed on my account!

    So far I have wrote them the following letter:

    Afterrecently obtaining a copy of my Credit File from the Credit Reference Agencies,I am concerned to note that your company has placed a "Default"notice against an alleged account I held with you at the address of XXXXXXXXXXX.

    Further to this, I have no recollection of ever receiving such a notice, and Itherefore require you to substantiate this data.




    1. You must supply me with a true copy of thealleged agreement you refer to. This is my right under your obligation tosupply a copy of the agreement under the legislation contained within s.78 (1)Consumer Credit Act 1974 (s.77 (1) for fixed sum credit. Your obligation alsoextends to providing a statement of account. I enclose a £1 cheque to cover thestatutory fee.

    2. Please also supply me with a signed, true certified copy of theoriginal default notice.

    3. You are notified that you are obliged to supply these documents,whether you are the original creditor or not under S189 of the CCA 1974.




    I would request that this data is provided to me within the next 28days. If you are unable to provide this data then I must insist that it isremoved from my files as unsubstantiated.

    They have responded with the following – which has slightlyconfused me:

    Loan sort code missing/invalid

    Loan Account code missing/invalid I did forget to out the account number / sort code on which I havefound!

    Unable to locate any customer details with the informationsupplied

    Account details provided do not relate to any loan account

    No trace of any loan accounts with the information supplied

    Customer consent missing or invalid.

    Please resubmit request with the above information, with 3rdparty authority, to enable us to provide your response.

    Do you have any advice as to where I should go from here? Andwhy do they need third party authority and am I obliged to give them any moreinformation other than the account/sort code?
