Mortgage/Renting after Divorce

Hi,

Myself and my wife are going though a divorce. I am renting whilst my wife and children live in the property I pay the mortgage on. My wife doesnt work. Its a joint mortgage however the borrowing was based purely on my income.

Once the divorce has completed, is it legal/allowed for me to rent the property back to my wife if she is removed from the mortgage. I wont be able to pay for my rent and a mortgage and the dwp only pay the interest on a mortgage.

Any ideas/advice will be much appreciated.

Thanks

John

"Renting a former joint home from your ex-partner

You cannot get HB if you pay rent to your ex-partner if you have separated and you have remained in the former joint home. This applies whether you were a married or unmarried couple."

You can rent it to her, but she will not be able to claim HB, and if she is not working how is she going to pay the rent?
  • OK. Thanks for the advice.
