HELP, someone outside my hosue trying to take my car

Hi,

I'm at work and theres a bailiff outside my house trying to take my car in relation to a CCJ that was served to an old address.

I've been trying to sort it all out, I've spoken with the solicitors handling it, done everything they asked and am in the process of trying to get the judgement set aside as per the advice of the court. I've done everything I've been told to do but the guy is saying that unless I pay in full now they are taking the car.

What can I do to stop him?

    If he's there right now then your only option is to call the police. They don't get involved in civil disputes but it might make him come back another day, giving you a chance to sort this out.

  • I would understand if I was just chucking the letters in the bin ignoring the lot but I'm actively trying to sort it out. Surely if they have a warrant the police won't get involved.

    Maybe not, but you asked for immediate solutions.

    If you tell the police that you dispute the validity of the warrant of execution and want to report the theft of the vehicle, then they may encourage the bailiff to move on, buying you some time.

    This is true, good point.

    I've also seen that if I tell the ballif the car is used for work (which it is, I'm self employed) they can't take it.

    ^ Do you own the car outright or is it on HP or financed?

    If it's HP or financed, bailliff should not take it away, as it's not your car until fully paid for.
    Mortgage deposit pot June 2012 = almost there.

    CCJ removal date = May 2014 :(

    I would have phoned the police with no other information but that a neighbour has just phoned me to report someone attempting to break into my vehicle.
