Can I apply for LILA while in a Protected Trust Deed?

On behalf of someone who is in a protected trust deed, is on benefits, really struggling to make payments and missed last months a LILA would seem like a better option.
Does the trust deed need to fail before a LILA could be applied for or could this be done straight away?
