Card Dispute

Morning all,

I am not sure if I am posting in the correct section :huh:

I went to a bridal shop in Southampton to purchase a dress for my daughter for her year 11 ball. Now really sadly her grandmother is ill who lives abroad, which means we will not be here, we have to travel to see her and take care of her.

I contacted the bridal shop and explained my situation and to say I was very sorry about the matter, but as no alterations were made and the dress had not been collected, would they mind refunding the dress, minus a re stocking fee of £75 (the dress cost £200), and I was met with hostility basically saying this is not my problem.

I was shocked considering the circumstances, but apparently they operate a no refund policy. The dress was paid for on 26/05/12, but paid for over the phone, does this give us any further protection of maybe reclaiming through the bank? It was a debit card however.

    You would not be covered under any card I'm afraid, the company havent actually done anything wrong. Its just that you have changed your mind (in their eyes)

    Can you change your travel plans, could you daughter stay here and go to her ball, then go over later.

    So, unless you come up with another solution, ie selling it on to one of the others who is going to the ball or on ebay, you are stuck with it.

    How old is she (sorry, year 11 means nothing to me)

    I agree with you, though, unless the goods are faulty, or were sold under the distance selling regulations or the retailer indicated before the sale that they would take them back then there is no recourse.

    If the circumstances DID mean a refund should be paid and it was refused then payment on a credit card could have resulted in protection under Section 75 of the Consumer Credit Act 1974 if the cost was over £100 (assuming it was less than £25K!) but I do not think that applies and in any case the OP says it was a debit card.
