Capital One PPI Rejection

Hi,
I had letter recently from Capital One saying that they were rejecting my PPI claim complaint because I ticked the box to take out PPI on the application form for the credit card, and that I met the eligibility criteria of the policy.

That was done back in 2002.

At that time, the norm was to take out PPI.

They have sent me a copy of my application form and looking at it now, it is misleading.

It states as follows:-

INSURE YOUR PAYMENTS
I would like to insure my card repayments against redundancy,...,..., accident, sickness or loss of life.

I HAVE READ AND UNDERSTOOD THE ENCLOSED
PAYMENT PROTECTION INSURANCE LEAFLET TICK BOXES

Looking at that application form now, the Tick Boxes are in the wrong place as I thought I was just stating I had read the enclosed PPI leaflet.

There should have been 2 sets of Tick Boxes.

One set to say Yes or No to take out PPI and another set to say whether or not the leaflet had been read.

I may have been eligible, but it was not necessary as I was not self employed.
I was nieve and did not fully understand about what PPI was.

Anyone else been rejected for ticking the Yes Box?

Do I have a case to go to the Financial Ombudsman?

    I wouldnt say it was the norm to take out PPI. Some people did. Some didnt. Like today, there is absolutely no issue with having PPI if you want to have it.

    What makes you think it was not necessary as you were self employed? As it happens, the choice of over whether it was necessary or not is between you and your financial adviser. Not Cap One.

    Ok, so lets assume we believe you made an error. This was back in 2002. Why did you not first complain back in 2002 when you saw the first PPI deduction from the statement? Surely if you were paying for something you did not request you would have queried it? The fact you took 10 years (120 statements later) to complain suggests it is more of an opportunistic try-it-on. The longer time goes by, the less credible that excuse is. If you complained in the months after taking it out then it is highly credible.
    Do I have a case to go to the Financial Ombudsman?

    You can go to the Ombudsman of course. However, your reasons are weak and largely dont matter as no sales person was involved. You bought the PPI rather than it being sold to you. For reference, the FOS only overturned 11% of Cap One complaints. Cap One do have a very good reputation on complaint handling and the odds are against you in many ways. If you really feel a wrong has been done then use the FOS. If you know you are trying it on then the reasons you have are not good.
