    Hi All

    Just had some upsetting news from the FOS saying that they are recommending they do not uphold my complaint.
    1.Due to the fact it was prior 14th Jan 2005 sale of PPI policies were not regulated. they were able to consider my complaint because it fell under the MCCB this means they have to comply with the Mortgage code. They said they could not see any way they breach the morgage code, even though I have an application signed without the payment protection ticked and when we received the FIRSTPLUS contract to sign the PPI was ticked even though it stated optional. When we questioned this we were told we could not have the loan if we did not take the PPI out. Now how can this not be meeting the morgage code... They said if wanted my case looking over by the FOS again I must reply by the 14th feb. I am just concererned that I have provided this information but must I circle the obvious for them to see?? Need to reply by the 14 FEB 2014 otherwise they will consider the case closed. This has been going on since 2012, please can anyone help I am desperate to beat these bullies that have made my life hell.

    In the complaint that you sent, did you use the wording I gave in post 27?.
    The full cost of the PPI would not have been explained fully to you at the point of sale, you told the FOS that you did not tick the box for PPI and questioned this with FP, saying "you had to have it" is your word against theirs I am afraid, you should respond with the fact the full cost and unfair rebate were not explained to you or the fact that at the 5 year point you would receive the cash back, have no insurance for the remaining term and not get the interest on the PPI paid for the 5 years, win win for FP.

    Thanks for your response, indeed I did quote the post from 27, I dont think they looked at the pictures of my documents very carefully as the application to LoanLink shows no PPI ticked and I signed that. FirstPlus contact arrived with everything ticked and luckily I have a copy before I filled anything in or signed it. Those were sent in my orginal complaint but I am sure they have been over looked. The fact they pushed FOS away was due to the fact that it was before 2005 and they are reisticted into what they can uphold, hence the reason FOS are going the Mortgage code route as they can regulate that but its alot easier to get out of for loanlink I think.

    I am going to write back saying that I dont accept their decision and would like my case reviewed by the FO and note the pictures once again to prove they did neglected the morgage code by forcing me to go the PPI route and with the fact the full cost and unfair rebate were not explained to me or the fact that at the 5 year point I would receive the cash back, have no insurance for the remaining term and not get the interest on the PPI paid for the 5 years
