Liability question please.

If your employer sends you out on a job (steel erection) to a building site and you have an accident whilst there who would be liable?
my friend was sent on a job with a few others and some steel fell onto him crushing his arm, 4 months later his employer is denying liability and saying he must claim off the main contractor.

    For them to be liable you must prove their negligence which is defined as doing something that a reasonable wouldnt or failing to do something that a reasonable person would do.

    Unless your contract gives some further cover for injury you would need to prove what his employer had done negligently that resulted in his injury

    Was this reported to the HSE or relevant person who was in charge of the H&S on the site ? My understanding is that someone will have responsibility for H&S and if anyone is injured, they will have to record this in some way. What records were made of the accident ?

    I think your friend should contact the HSE to ask for their advice on this.

If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
