Barclaycard ppi claim unsucsessfull please help

I made a claim for my Barclaycard PPI insurance via the usual letter etc and i have been declined my claim and i would like to take this further but need some advice.

Basically i am trying to make a claim that goes back to when i first took out my Barclaycard in about 1993 on which i have had PPI
i have got barclaycard statements going back to 1994 so there is no question that it is there, But the letter that i have had back from barclaycard says that.
" We have identified that my application was submitted by post. At the point of applying for PPI, as no advice was given the process required the customer to select the specific type of cover they required"

Well this was in the days before the web and email etc and all these types of things were done by post.

I was under the impression that these claims etc are able to be paid out if incorrect advice was given out or no advice was given out based on other PPi being available etc etc,

so if i was not given any advice at all then surely i still have a cliam for this, i was only 21 at the time and this was the first time i had ever done anything like that and i would not have known what PPI was back then anyway.

I was probably keen on just getting the credit card,
I reckon i am owed thousand,s on this and i dont want to let this go,
I did phone the FOS and i spoke to a guy that really did not like me asking these questions and didnt really want to answer any questions, he was very candid.
I have got the balls to take this further but i really need to know if anyone thinks i have a chance at getting this claim.
Can anyone give us some advice?????

    So you applied for PPI, nothing was sold to you, as you applied for it.

    You have mis-understood. No advice was given, no one sold it to you, no one explained anything to you as it was a non-advised sale which you applied for via post.

    You cant allege you were given poor advice when no one advised you.

    Being 21 (i.e. over 18) means you are considered to be grown up and able to take responsibility for your own decisions (that is why you cannot have a credit card before your are 18).

    It is not for somebody else to indemnify you for decisions you now regret.

    So I do not think you are owed anything.

    If the wrong advice was given then you have grounds for complaint. If no advice was given and you bought it yourself then the only person you complain to is yourself.

    You cannot complain about advice if no advice was given. You acknowledge you were an adult. So, you should expect to behave like one and be treated like one.

    The FOS telephone line is not manned by ombudsman or adjudicators. So, their knowledge isnt great. However, they may have had difficulty in explaining to you that you have nothing to complain about. Sounds like you have buyer remorse as this certainly wasnt mis-sold.

    Mis-sale relates to someone selling it to you in breach of their sales process or advice process (if you use an adviser). You say it was not sold to you. So, no mis-sale.

    I am in exactly the same boat as you. I applied for a Barclaycard in 1990 but didnt realise I took out PPI cover until only recently (I know, I know). I cancelled it and in March this year I claimed PPI compensation. Barclaycard eventually replied with exactly the same letter and the same wording as yours, stating as I applied by post... blah, blah, blah.

    I have just written back to them, asking for a copy of my original claim, just to see exactly what I applied for, as I dont remember and have no copies going back 22 years.

    I'm going to take it from there. It's worth a go I think.

    I received the same letter today. It's total rubbish. I applied in a branch not by post for a start. I requested a copy of the application and got a generic form from that era (1990) that doesn't mention PPI and doesn't have my signature on it.
    Looks like I have to go to the FOS now.
    It has taken 5 months to get to this point. I think Barclaycard are just doing this to clear the backlog.
  • I got rejected today on the grounds that I apparently never had PPI even though I have provided copy statements to them clearly showing the payment protection amounts every month! I am sending mine to FOS on the grounds that they clearly haven't looked into my complaint properly, after 12 weeks, because they haven't even looked at the paperwork I provided them with! Ridiculous, but funny :)

    I'm in the exact same boat as you, i have statements back to 1996 showing i've paid PPI etc , I've submitted a claim and was declined, my letter from Barclaycard is exactly the same as yours.
    I know my application was done with a representative in a Barclays Bank as i got a free Barclaycard Rucksack with my application and firmly believe that all i did was give my details and signed the application.
    Did you manage to get a copy of the documents you asked for from Barclays ? did you pursue it via the FOS ?

    barclaycard tried same reason for rejection with my claim. "postal application". mine was done in branch,was told by advisor i couldnt have credit card unless i took out ppi with it. no info given on it being separate to card. just filled out form,and "they" posted it off.
    The only reason i kept ppi on the card for the whole time i had the credit card was due to me being "informed" i couldnt get credit card without it. so had no reason to cancel something which from the advisors information given to me in branch at the time of getting the credit card, would mean if i did ever "cancel" the ppi,i would be cancelling the credit card aswell. " no ppi ,no credit card".
    FOS gone in my favour twice, barclaycard rejected once,waiting on there response to FOS going in my favour the second time.
