Faulty Purchase on Credit Card

Guys,

Quick question. I have just bought (2 weeks ago) a new camera from USA on my CC.

Its deveolped a fault and it isnt covered under UK warranty only USA. I can send it to the USA but that extra charges I dont wanna incur.

As I bought this in my CC, what are my options, if any? Can/will the CC company help/assist?

    They will be able to help but they'll probably ask you to send it back for the retailer to look at. At your cost.

    You bought from the usa, so if you dont want to return thats your fault not the retailers
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Well No. Its not my fault I was sold a faulty item was it. So therefore If i can avoid paying the charges I will. But if I need to pay then i understand I must.

    You will need to, as it will be american spec also

    Your credit card wont be able to help under the chargeback scheme if the item has developed a fault (i.e. was working when you initially got it, regardless of how long for) as the regulations do not cover an item that has become faulty. If it was faulty upon delivery then they should be able to help you but you will need to do a couple of things first. First off you must make an attempt to resolve the matter with the merchant (regardless of the card scheme, this is needed for all). If you cant resolve it with the merchant then the card issuer can step in to dispute it, again depending on your card scheme you may or may not have to return the goods to the merchant (at your own cost).

    If the item has developed a fault & it cost over £100, Section 75 might be your best approach if you cannot sort it with the merchant first.

    I have spoken to the merchant in the USA. He is unable to post a replacement outside of the USA as its his company policy not to ship abroad.

    So I can send the camera to Nikon in the UK but they will charge to repair. Do you think Section 75 will cover this?

    If you personally imported the camera (ie, you went over to the USA, bought it, and then brought it back to the UK), it's unlikely, as this clause will be on your terms and conditions of sale.

    If the company has just decided to change their selling terms and conditions, it might be possible, but I'd still say its a grey area and the CC provider may refuse.

    Also, have you checked with Nikon UK ? They may refuse to repair the camera, stating that it must be sent to Nikon USA. I know someone else this has happened to with similar equipment.
