Most scams can be avoided if people exercise due diligence, and I agree that they should take part of the blame for not doing so. Where we disagree is that you think they should take 100% of the blame whereas I think the perpetrator should take a significant amount of it, and this includes when it's a case of intentionally snaring the unwitting but staying on the right side of the law.
I think we are going to have to agree to disagree on this one then. There are hundreds of firms which use this kind of marketing ploy, even down to the likes of Love Film who offer a free trial but you are responsible for cancelling it. They rely on you not doing just that. Its there for all to see in the T&C's that you need to do it, but a lot of people just do not read it.
They are making money from people who just don't read. I still feel thats defendible. You are physically required to tick a box agreeing that you have read and agree to their terms. They have covered everything they need to legally. If you tick to say you have read those conditions when actually you havent then you can't be surprised when something pops up that you were unaware of. At that point if it had happened to me I'd hold up my hands and say 'ok, my fault I didn't read it!' I may even post a thread just telling people to be certain to read T&C's before they sign up to something, but I certainly wouldn't be calling the company scammers or con artists because the fault lies 100% in my inability to read in full.0 -

Certainly we can agree to disagree, and yes many companies do operate on the basis that it's up to you to cancel. The key to it is how clear this is made or what happens if you don't cancel.
Coincidentally, I recently signed up with LoveFilm and they did a good job of making it clear to me what the position was without having to first read the small print ... so no complaints. If someone's business model is a deliberate attempt to bury things deep in the T&C when they could make key conditions clearer, then that's a different issue.0 -
