No fault claim but driver not insured

Hello..

My car was parked and unattended in a regular parking bay and someone pranged it whilst they were parking in the next bay. I have independent witnesses.

It turns out whilst the vehicle that hit my car is insured the driver isn't insured to drive it. How do I stand if I make a claim? Could I lose my excess? Is there a third party liability clause that would protect me if the vehicle is insured?

My insurer wants to pass my claim to Drive Assist but Im not keen on taking a hire car from them because although its a clear no fault case the uninsured driver will likely kick up a fuss.

Im tempted to try for a private settlement to save time and hopefully protect my premium from a hike next year. The driver will also prefer this if he's got any sense.

Anybody have any thoughts? Thanks in advance..

    the other vehicle insurance will pay exactly as if the driver was insured.

    Your excess will probably have to be paid & reclaimed from the third party if you claim on your own insurance. If you deal direct with the third party insurer then this doesn't apply

    and, as you have already informed your insurer you are likely to face a "non fault" premium loading for the next 3/5 years in any event as it will be on the CUE database and you'll have to disclose in future.

    If this loading is significant and you CBA then it is possible to reclaim it from the third party

    Thanks for the replies vaio - its crazy that Im going to be penalised just for picking the wrong parking bay at the wrong time. Such is life.. and so called insurance.

    Have you reported it to the police?

    If the owner knew about the driver taking the car thet can be done for it.If not did they steal it?

    Maybe a claim from the MIB?

    They don't need the MIB, they can claim directly from the Insurer of the other vehicle

    I haven't reported it to the police and yep I realise that the owner potentially commited an offence by letting someone he knew not to be covered to drive it. If I went the insurance route Im not sure if this would get them both into trouble or if it would purely be a financial penalty through the claim.

    I wasn't even aware of the MIB so thanks for flagging that up.. hopefully they won't be needed though!

    ps: Looking at the driver and his two passengers, I don't think they stole it, more like borrowed it to haul something home. Next time I go to Ikea Im parking in the bit furthest from the entrance!
