Advice greatly appreciated, Barclaycard PPI

Hello everyone

I'm a newbie and would really welcome some advice on claiming PPI from Barclaycard, if I may.

I took out a credit card with Barclaycard 22 years ago, back in 1990. I have been paying PPI all these years, until only last year when my husband spotted it on my statement and told me to cancel it immediately, which I did. I had no idea I was paying it for over 20 years - embarrassingly so. :o

8 weeks ago, I took out a claim with Barclaycard and have just received a letter back from them. They said they would not uphold my claim as I had applied for the card by post and had (apparently) 'ticked a box' on my original application form requesting this cover.

The problem is, I don't even remember how I took out this loan, not to mention remembering requesting PPI on the form. I also do not have any proof as to whether I spoke to anybody on the phone regarding taking out this credit card, or did it purely by post. 22 years ago is a long time and I just can't remember how I applied for the card. Also, I don't have any paperwork dating back 22 years ago to prove anything.

At the time, I was in a well paid job, living at home with my parents so I really didn't have any reason to take this cover out and more than likely didn't even realise what PPI meant back then. I probably just thought I had to have it.

Barclaycard have suggested I contact the FOS now, but I would just like to get your advice to see whether I have a leg to stand on really.

Your thoughts will be greatly appreciated.

    Did Barclaycard send you a copy of the original application form? There would have been one regardless of whether you applied for the account by post or by phone. It will show on there whether you opted out of PPI or not.

    No, Barclaycard did not send me a copy of my original application form.

    I would ask them to furnish you with a copy of the original application then (showing the ticked box).

    Well it won't hurt to try, but in my case, they sent me a copy of my agreement, and the box was ticked (meaning I opted for ppi). It was a photocopy but I did still have the original after 20 odd years! and sure enough I had ticked it. Their reasoning when declining my claim was that they sent me various communications in writing giving me the option to cancel, or when terms/conditions changed, and the charge did show clearly on all subsequent statements. I could have cancelled at any time.

    Which is true. I couldn't prove otherwise so I didn't take it any further.

    Depends if you ticked it or not, just because they say you ticked it doesn't mean you did.

    We got exactly the same reply from Barclaycard saying we had applied by post when my OH actually applied in branch. They subsequently apologised for that but insisted my OH ticked the box, we haven't seen the actual application form though (10+ years ago)

    Our claim is now with the FOS.

    Don't take any lying banks word for anything.
