Dont think the cca route will work, as tesco I dont believe were aboute pre 2007
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Thanks all

I will change my standing order amount & write to them telling them that's all I can afford

I can't remember when the card was taken out as I no longer have any statements. As its off my credit report not sure his I can find this out

I did write to tesco a whole back asking for details of card charges to try & claim back but got a response with a spreadsheet attached saying no charges were made (impossible!) so will have to leave it at that. Sorry I know this is for a different forum

Just really worried as I said that my report will be damaged further 6 years if they take me to court. Am working hard to repair my report& luckily a lot if my debts are starting to drop off now even though some are still outstanding

    Do this, do no more.

RW are scum and need treating like such. If you want to pay them £1 you pay them £1.

If £25 is what you can afford then write to them telling them that and change your standing order to reflect that. If you have a Direct Debit, cnacel it and arrange a standing order.

They want anymore, they take you to court. They won't as they know that the court will not look kindly on them.

Do everything in writing now, nothing over the phone. If they phone, just tell them you have written to them explaining the position and hang up. You will get loads of empty threats as the low life call centre monkeys work on theats and people like yourslef being scared.

You are doing your best to resolve this situation. That is all that matters.

    Do as The Chippy says.

    I really hate these people.

    E2

I disagree with you about them.

They have an ex-cahoot debt of mine, and as I have made every payment that has been agreed (and indeed increased them annually) through my DMP with Payplan, I have had no problem with them at all.

    Send the cca request still.

If the document is non compliant (or non existent) that could be invaluable ammo for the future if needed....;)

So I should change my standing order to £25 and write a letter explaining my situation and this is the maximum I can afford

I will also ask for a copy of my credit agreement di I request this direct from tesco?

If they don't have a copy does this mean j may not be liable for the debt after all this time even though I have been paying it off now through Robinson way but if has previously been with wescot credit services and Regal credit

Maybe I should also request the charges again as well surely they have a record of these

    Send the request to RW.

    Dear Sir/Madam

    Re:- Account/Reference Number xxxxxxxxxxxxx

With reference to the above, we would be grateful if you would send us a copy of this credit agreement, statement of account and notice of assignment.

We understand that under the Consumer Credit Act 1974 (Sections 77-79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

We understand a copy of our credit agreement should be supplied within 12 working days.

We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

We look forward to hearing from you.

    Yours faithfully

And yes, change your standing order and write saying that's the max you can afford.

you stay liable for the debt. just if there isnt a cca they may not be able to succeed in court against you. so could put you in the driving seat when dealing with them
