5 Years after Afghanstan HL Solicitors are back...

Almost five years on and life has changed for the better. No debt (except a mortgage), girlfriend, Flat and whilst I went back to Afghanistan a second time... no more injuries!

However... HL Solicitors have recently contacted me about the debt that you guys advised me on last time... it just seems to periodically re-appear.

The situation is that the last payment I made was on the 24th of April 2006 by direct debit. After that no more payments were made until in September 2009 HSBC took £120 from my account and credited it to the debt collection agency - I must stress I in no way facilitated or ordered this payment.

So now HL Solicitors are taking me to County Court for about £8,500 and I don't know the best way of fighting this.

Does anyone have any experience or has anyone been through this.

I have requested a signed copy of the Consumer Credit Agreement and I have less then a year to go until the debt should be technically viod anyway - am I missing something?

What is the best way to fight this?

The debt was originally in dispute with Equidebt when I first did battle with these people and since then I have heard nothing from them and it has been sold on... is this legal?

    OP did the £120 ever get returned or was it explained how it was granted?

    As for statute barred it would have been passed already? Last recognised payment was 24/04/06 so 6 years ago last month.

    The main reason that I pursued this was an emotional reaction to HSBC refusing to discuss the matter with me.

    I went in to the office on crutches pretty messed up but willing to do business and when I saw the manager he left and sent a trainee to tell me not to come back.

    I was pretty emotional at the time as I had been through some stuff and I didn't feel that HSBC treated me like a customer - they were happy to charge me £200 a month interest on a credit card but couldn't afford me the time to discuss it like adults.

    If HSBC sent someone who actually worked for them instead of a fourth, fifth or sixth party to discuss this with me I wouldn't hesitate to settle this today.

    On a more educated level I could say that the strategy of lenders was to push the borrowers over the precipice of debt into a situation where they will never pay off the debt (this happened to me I have bank statements which show I was paying 40% of my income on debt repayment without actually reducing the total).

    When I contacted HSBC to ask them to negotiate a repayment plan they offered me something that was unacheiveable. I can understand that you are making a moral argument to repay the debt and that is my preference, but in my experience lenders only use existing debts to manufacture more debt to enhance their own profitability.

    The money I owe is accrued interest rather then capital expenditure.

    Without going too much into the pstb thread , IF this debt isn't statute barred I'd make them prove that. Send them the template letter here telling them it is and see what they do?

    Taking money from your account to pay the agency seems strange, not to say very dodgy tom me? I could understnd them taking it to pay a debt to them but isn't this them paying someone else without your permission?

    Hope you get it sorted mate, terrible way to treat any customer never mind one in your situation :/
