ParkingEye appeals

I have unfortunately read these threads after getting into an appeals process with ParkingEye. I received a parking notice after parking in the Marriott Royal County Hotel in Durham City. I was attending a conference and I mistakenly thought that parking for delegates was free. After being parked for about an hour and a half I was then told by a member of the hotel staff that parking for delegates was not free and so I would either have to pay for parking or leave the hotel car park. I knew that parking was cheaper elsewhere in Durham so I drove out of the car park and parked elsewhere. I then got the letter from ParkingEye a week or so later saying that I owed them £60. I then appealed to parkingeye (unsuccessfully) and also appealed to the general manager at the Marriott hotel on the grounds that I did exactly what I was told to do by the Marriott hotel staff memeber. The manager at the hotel was not very simpathetic and said that I would have to appeal to Parkingeye. I have had a number of letters from Parking Eye and have replied via email to each letter I have received. I have asked ParkingEye and Marriott hotels for an exact description of the letter I received - is it a fine? invoice? or just a money making scam? and they have never answered this question.
Have I got into this correspondance too deeply now to start ignoring the begging letters or not?

As you have discovered, there is no such thing as an appeal with these clowns. You may get more than the usual number of letters as they will have you down as a potential mug, but just ignore them from now on.0

They are not likely to admit it is any of your three options, are they? They like people to assume it's a fine... but cannot, for legal reasons, say so.
The appeal system is a total sham whose chief objective is to open a dialogue with you so they can try and pressurise you into paying.
It's unfortunate you went along with it, but to be fair, many people do because they assume this is all genuine.
It isn't. It is a scam. All you have to do is to break off all communication, totally ignore further correspondence, and they will go away, no matter what has already transpired.
They don't have any option since their "invoice" is completely unenforceable, and the only means they have of getting you to pay it is to try and scare you into doing so.
Be prepared for a few transparent threat-o-grams; if you don't reply, they WILL go away.0 -

ParkingEye have actually sent me 2 'invoices' for the one parking 'infringment'. The first one said I had to pay by 8th May or the payment would increase from £60 to £90 and the second said I had to pay £60 by 4th June (tomorrow) or it will increase to £90.
Having read the other threads about parking fines I am feeling the same as other people on here that I may be the one that is singled out for a court appearance.
I have a work colleague who got the same ticket as me on the same day for parking in the Marriott hotel in Durham but he paid up straight away and is now trying to go through the appeal process to get his money back. I fear he has no chance of this ever happening.

Read my lips, even if Parking Eye had a rush of blood to the head and felt inclined to take you to court, they could not do so anyway. The recently decided case of V.C.S. v H.M.R.C. determines that parking companies cannot sue unless they own the car park; only the Marriott Hotel can sue you and there's no chance of that happening, is there?
All bluff and bluster- for Heaven's sake, stop falling for it and see through it!
As for your friend, his chances of recovering the money paid through their appeal system are a big fat zero. Scammers do not repay their victims. Not under ANY circumstances.
He could get the money back, but would have to take out a County Court claim to do it. This would succeed- in fact ParkingEye would pretty certainly not fight it- but it is his only option. He is totally wasting his time trying to reason with them.
Edit: As usual the hotel are also leading you down the garden path. Parking Eye work for them and must follow their instructions. They have full powers to tell their AGENT to cancel the charge. Maybe they get a cut of the ill-gotten gains and that is why they reward you patronising them by scamming you.
Stay somewhere else in future- preferably a place with no parasites in the car park, lol......0 -
There is a church in Inverness that meets in a hotel where the car park is "managed" by Parking Eye. The members regularly get invoices despite complying with the "rules". Best ignore them.0
