ppi claim joint loan but now divorced

i would be grateful of any advice please

i received a letter from lloyds tsb in my ex husbands name and mine, it was a final offer for ppi claim , my ex had put the claim in on all joint loans first i knew was when the final offer arrived. he paid remainder of a loan we had but it was in joint names as where all of them. the ppi claims total nearly £19,000 he's been in touch and said although the loans were in joint names he wants me to write to allow him to have ppi claim for loan he finished paying off which is an offer of £12,000 claim payment, he says he will happily split the others so i'll get £3,500 and he's says he has to give the bank approval to send cheque to me in my name as they have been sent to his address with both our names on.

please can someone help advise me
do i have the right to all the money from loans 50/50
if ppi in his name will i be eligable (not sure if joint but loans were),
what do i have to do to claim 50/50 and get names on cheques changed
if i dont agree what will happen

    I think it fair that if he cleared one Loan off with a lump sum, then he should get this money back, you would if it were you wouldn't you?, I am not " having a go" here, it is how my mind works :) I would want it if it were mine.

    As this Loan was in joint names it should be 50/50, you can contact the bank and ask for 2 cheques, explain that you are separated and no longer have a joint account and you want your share direct to you, only do this if things won't turn nasty with ex, money is not worth grief in any situation, unless your ex is amiable.

    If you will not sign to say he can have the large win then he can go no further, he can only do what you can do for the 50/50.

    Just a thought, did you know he was putting the claim in? if not and he tried to do it without your knowledge ( and realised he had to tell you as the cheque was in joint names) then go for 50/50 :)

    hi i see where your coming from regarding him paying for the loan but i paid towards its until we seperasted so was 2 years in the deal was i got £3000 he continued the loan and kept the house.

    i had no idea the ppi claim was in until the bank sent the joint letter saying what the payouts were going to be

    he said he has to give approval for cheque to be sent to me , not sure whether he can put a stop to me getting anything any ideas

    I don't think that he can stop you getting 50% of this, see if you can work this out between you, or go to the bank and ask for your share as you are divorced.
    Let me know what happens as this may help other posters who may be in the same position.
    I wouldn't like to have to sort this out, good luck.
  • My husband has been sent cheques in joint names with his ex, but he took on the loan as part of the financial settlementin the divorce. He is willing to give his ex a share of the cheques pro rata for how long they were together when the loan was being paid off. However, the majority of the loan was paid off after he split from his ex. Most of the cheque money is for interest he would have accrued if he hadn't been missold. So,as his ex didn't outlay any money to pay off the loan, why should she be entitled to interest as compensation? It seems unfair:(

    well after a long wait i finally received my half of the ppi settlement direct from the ppi claims section, not sure what happened with my ex but think he got away with cashing all the cheques.

    result though i got what i was intitled to . . . . one happy lady x
  • During divorce i had 2 pay half of my ex husbands credit card in the financial settlement, even though card in his name only. He said it was marital debt! I have recently discovered he has been awarded substainsal ppi. As i had 2 pay half am i entilted 2 any of ppi???

    Might be worth a try if you have proof of the settlement, may not work but you have nothing to lose.
