  • A solution was found. The money was put into a trust and the Housing Benefit Department allowed my claim.

    How is it fraud when it's not her money? Are children's savings taken into account for means-tested benefits? (genuine question, I've never had to claim them).

    Before moving over to ESA, I was on income support and had to declare my childrens savings, as they were taken into account.

    Perhaps it's different for ESA??

    Children's capital is no longer counted - explained in this document, para. 57. ;)

    That's good to know as eldest child will be coming into some money next year.
