Ebay tricky problem, need some good legal advice

    As a regular Ebayer, I have had several occassions where stuff I have bought have not worked, not turned up, been the wrong colour etc and the seller has not responded to contact. The first thing you should do is contact paypal and open a dispute - this can be done by logging into paypal, click onto 'Resoloution Centre' and then on 'report a problem', after which they will guide you through the complaints procedure - make it clear you paid and contacted the seller but they are fobbing you off/ignoring you. PayPal will then contact the other side, but if all they get is silence or rubbish excuses then they will refund your money very quickly

    Hmmm, maybe you should try contacting the seller first if something is not as recieved rather than going straight to Paypal. Mistakes happen - we are all human after all - but running straight to Paypal is pretty rubbish to be honest with you and pees most sellers off, regardless of whether a mistake was intentional. If, for example, I sent something in the wrong size or colour and you immediately opened a dispute without any contact the the first thing I would do is stick you on my blocked bidders list and just wait out the 10 days until Paypal give you the money back - after you have escalated of course. If you had come to my first I'd have had it sorted out - at my own expense - within 48 hours.

    Buyers who have no understanding of human beings making mistakes drive me nuts and I am sure others will say the same. I make the odd mistake due to the volume I sell in but I think it VERY rude for a buyer to ignore you and run to Paypal and open a dispute without giving the seller a chance to sort it out.

    Only this week I had someone mail me and typing half the sentance in capitals because something did not arrive by 1st class mail 'I WANT MY REFUND NOW, I HAVE PAID YOU' BLAH BLAH, BLAH'. This is the kind of customer I can do without, sure I'll refund and chase up with Royal Mail but there is NOTHING worse than someone emailing you and is quite obviously being rude about it. And I told her so as well!

    Sorry, but I hate stressed out people who decide to have a go at EVERYONE because they have a bad experience. Try reading the post properly before slinging out comments againt them.

    However, your maiden post is incorrect in its analysis.

    After speaking about things going wrong generally, yalisrib said: "The first thing you should do is contact paypal and open a dispute ".

    This is bad advice. You should always contact the seller first.

    I suggest that you take your own advice: " Try reading the post properly before slinging out comments againt them[sic]".

    I will see if I get my money back on 16th, what do you reckon on me bidding on the new listing and winning it again? As this is an old unpopular console, theres every chance I will win it again...... very tempting.....

    Change your user name though so they don't smell a rat and block you. Maybe get someone else to buy it and then you pay for it (partner?) but no reason why not. Ebay do not do didley squat to be honest - all they are concerned about is getting their fees paid on time. As long as you have not lost any money that is the main thing but open another account and get a new name before you bid again. Oh and yes, if no response from the Seller do a Paypal chargeback and get that in motion!

    blue_monkey was quoting yalisrib and not the OP.

    Funnily enough yalisrib has now edited their post to look like they only go to paypal dispute after seller hasn't responded to contact. :rotfl:

    Therefore you should, as well as claiming via PayPal, report them to eBay for 'false contact details', which is a grave offence.

    The eBay feedback system requires bravery on the part of hard-done-by users in order to be effective, retaliatory negatives are unavoidable :( but other bidders need to be warned and you can always leave a calm, factual response to any neg you receive. If you left him a neg now you'd be doing a great service.

    I know how you feel, I have just suffered at the hands of a seller who didn't get the price he wanted - I did get my payment back but not the compensation he promised. I've also been diddled in the past by false descriptions, but if it's relatively small money it costs too much to get justice.
