It's not a regulation, its just common law (i.e. case law built up over centuries). Paying part of a debt (except "under protest") can create an acknowledgement that the debt is yours (and also re-starts the 6 year time limit for claims)
I remember reading of one man who was being chased that wasn't his, because he had made one payment following a demand, thinking it was better to pay something to keep the debt collectors away whilst he sorted things out. Bad Move.We need the earth for food, water, and shelter.

ha ha, I do find it amusing when people read half a post thread. So just for clarity
1. I never used the cards as I'd cleared them and only used for emergencies.
2. The reason I didn't notice is because they were posting letters out but I left the house each day at 6am and he was disposing of the post. No way in this case of actually reading my statements!!! Also remember I said the cards were fully paid off so I wasn't actually expecting any statements.
3. They didn't have up to date phone num as altho I'd informed them innediately of my new address I didn't have a phone installed immediately and had forgotton to then inform them of the new number.
4. The only security details the gambling sites had requested (take into account we are going back 5 years) was the details on the card (ie CVV number, expiry etc) was my mothers maiden name and the billing addresses of the cards, both of course which he knew.
5. My query was 'IF I'd taken it to court at the time do you think I would have been successful'? I'm not considering taking it to court now, it seemed a mountain to climb to prove burden of proof then never mind 5 years later.
6. For thne people saying how did I not notice a joint bank account being emptied. I said 'I DID notice but thats another story'. That was easy to prove more difficult to sort but it was sortable and I did.

2. Did he sign up to the gambling sites in your name or his? Presumably yours so it matches the card details. If in your name you should check to see if the accounts are still open - you want to make sure the accounts are closed, and you never know it's possible they still may have some money in them (OK unlikely but possible - particularly if the only way they'll allow a withdrawal is to your card).
3. How was he withdrawing gambling wins? Gambling sites usually insist on repaying to the card used for the deposit.0 -
Still some unanswered questions
1. Were the cards being paid? If the CC companies didn't get their min payment every month they should have stopped the cards well before a year.
None of the cards were stopped and no I wasn't paying anything because I'd paid them off and stopped all dd's and no longer needed. I did ask all 3 companies why they allowed it to happen for so long, when previously I'd always paid off on time as I naively thought that one of the rules for responsible credit was 'changes in pattern' to usage and it was a COMPLETE change, but alas no it would seem not, or not then don't know if things have since changed.
2. Did he sign up to the gambling sites in your name or his? Presumably yours so it matches the card details. If in your name you should check to see if the accounts are still open - you want to make sure the accounts are closed, and you never know it's possible they still may have some money in them (OK unlikely but possible - particularly if the only way they'll allow a withdrawal is to your card).
Not a clue to be honest re:whoose name they were in. He would never actually tell me which site (I only found out it was gambling when I asked what the money had been spent on), what I've since done to get around this, is stop all the cards (so they are now accounts that are just being paid off I can't draw from them) and also changed some of my security details. Having no immediate family means I can select such things as mothers maiden name for example ):o

As far as I know he wasn't, a true gambler doesn't keep the money they just gamble it away again. Its in the thrill of the suspense 'apparantly'. If it was about winning you wouldn't have many gamblers. Only the betting companies win :cool:0 -

Credit card companies get stroppy if one monthly payment is missed, after 2 or 3 they should definitely have stopped the card. Never mind 12!! You should be asking them why the card wasn't stopped!
