Can employer make me redundant without pay?

Hi, hoping you can help me..

Our company (B) is closing down due to lost business, but we are part of a bigger group (A) and salaries are paid by 'A'.

I have worked for 'B' for 3 years and paid monthly but have never signed a formal contract.

Can 'A' let us all go without any redundancy pay or notice?

    I think if you can show that A have been paying you then you have a contract with A.

    What does it say on your pay slips and p60.
  • Payslips say company B, but have company A's details on them too. I will check the P60.

    Have they actualy said they won't be paying and intend for you to claim from the NI fund?

    how is B owned by or part of A?
  • Things have changed slightly and they are not closing the company down, but will make us all redundant. I just need to find out where I stand....
    I don't have a contract but have been here 3.5 years. Will the statutory redundancy regulations apply? Or can they weasel out of this?

    Will they have to give me 1 months (paid) notice and do I have to work this? Also, I have outstanding holiday allowance.

    If you have no contract then they have to give you 3 weeks notice ie 1 week for each full year (as you have worked there 3 full years) It is up to your company whether you have to work this notice or not.

    Redundancy is the same ie 3 weeks redundancy pay (if you are under 41 years of age) or if over then it is 1.5 weeks for each full year.

    They can make you take your holidays in your notice period. If they make you work your notice period then they have to pay you any accrued holidays on leaving.
