What if you didn't notice it and by the time you'd worked out the noise and clunking coming through your steering wheel it had damaged your wheel.
Could you sue them for damage?0 -

You could take it next time you go on a long drive and then tell them they can pick it up from your auntie in Inverness or some other place far away.I can afford anything that I want.
Just so long as I don't want much.0 -

This is the reason why they are supposed to attach the clamp to the wheel closest to the drivers door (normally the front right in the UK).0 -
Some intersting answers. Paid to get it removed but now putting together my MCOL claim due to insufficient signage and there is also some doubt as to whether the road was private or not. Will need to check with the council on the last point.

Any sia licence for clamping registered to them or a clamper registered / working for them ?You may click thanks if you found my advice useful0 -
Sueing the clamper is a waste of time. They will ignore any judgements or CCJs.
You need to sue whoever hired them to operate on that land. You need to find this out and make sure they are included in your MCOL otherwise you'll just be throwing the claim fees away too.Je Suis Cecil.0 -

So wish you hadn't paid the clampers. It can be cheaper to pay a local garage to remove the car, clamp and all. At least then the money is going to a REAL business up front - and you can still sue the same parties for your money back.
Anyway, make sure in your claim you also cite the recent decisions of HMRC -v- VCS and VCS -v- Ibbotson.
As well as rubbish signage, the important point is that, in any case, the clampers almost certainly won't have sufficient rights to the land to make a contract containing an offer to park. And they cannot claim for trespass - only a landowner can do that - nor for breach of contract as that would be a penalty (unlawful).
They are stuffed but I hope you do know you also MUST name the principal party? The company or person who contracted the clampers to be there (managing agent, occupier, owner?). Never, never sue a clamper alone (it's like 'suing a man of straw', you won't get your money even if you won and sent a bailiff in).
To make sure your case is worded properly aginst BOTH parties, get pepipoo's help:

Good luck, you should get your money back in a few months if you persevere.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
