Think Jessops have sold me a used camera as new

About a week ago, I reserved a camera at Jessops and was phoned later that day to be told they only had the display version in stock, would I prefer it if they ordered me in a new version instead, which I obviously said yes to.

So it gets there yesterday, I pick it up and switch it on, and am a little suspicious the set up doesn't pop up, which it is supposed to do (the fuji manual even states this). Instead, the time and date has already been set.

Then I decide to check out the exif data on the pictures I took and it appears as though the camera has taken over 100 photos prior to me buying it. In addition, the battery was half charged when I first opened it. I inspected it further and found a small chip on the zoom ring. Therefore, is it safe to assume the camera has been previously used?

Does anyone know what Jessops returns policy is? Should I have no problem obtaining a refund when it appears the item is not as described? I even asked in store later that day, are you sure this isn't a display model as the time has already been set but the girl fobbed me off, so it wasn't until I saw the file data that I was sure it has been used in some way.

    They tried to sell me an ex-display camera as new. I asked for a new camera, they said yes, come to the front of the shop and then someone went and took the camera out of the display and put it in a box!

    I was astounded, complained and left.

    Would depend if it was ex-display or a return. As technically speaking display stock is new, it has never been sold. Yes they should really explain it ex-display.

    Does it not say on the receipt what they there return policy is, ie 28 days and all that.

    The fact it is has a chip on the zoom ring may be enough to return it

    Doesn't say on the receipt. only says if it's faulty, but according to their website they have a 14-day 'no quibble' returns policy. I'd even be happy to accept a replacement if they could guarantee I'll get a new one that's not been switched on before.

    I'm worried they might accuse me of chipping the zoom ring.

    Just go in, you have nothing to lose. The camera shows signs of previous use, as well as existing damage. Pack it up, take it back in, and talk to a manager, as opposed to one of the sales floor people.

    I hated Jessops the last time I was in there. I couldn't move without being jumped on by several people trying to get my interest to buy whatever I looked at. Looked at cameras, two separate people approached "no thanks, I'm fine" went over to cases to check prices, another one tried to hijack me, walked off to the tripods, and again the same. I know customer service is good, but so is not badgering. That just turned me off from buying anything in there. The number of sales floor people compared with the size of shop was stupid.

    I would expect a new camera to be new and unused. Does the data show time and date for photos taken?. If you are not happy return it for a quibble free replacement.

    Just spoke to customer service who put me through to the store near where I currently am (bought it originally at a store near my uni). They've agreed to swap it for a new one.

    This new one apparently was ordered in for a customer who decided on a different camera. According to the manager, he got it out, switched it on and had a little play with it, but she supervised the whole time and it has since been back in its box, has never been bought and hasn't been on display.

    What do you think? Should I accept that rather than requesting a refund and buying a new one off amazon? I think at least with this one I can be fairly sure of its history. Will also check the exif data when I get it to see how many photos it has taken.

    The manager from this store seems much more helpful/honest at least. At least she told me a customer played with it, unlike the manager in the other store who assured me it had never been switched on when it had.

    Really didn't have a great experience in the original store tbh. First of all, the girl nearly sold me the wrong camera. I was getting ready to pay then I looked at the counter and realised she'd bagged up a camera that was worth £200 less. Then, she tried to force me into buying the warranty by saying i could only buy it WITH the camera until I pointed out that their own leaflet said it could be bought at any time. She was just unfriendly, unhelpful and a bit grumpy really. Even the manager used fear tactics - tried to get me to buy £150 worth of memory cards. I said that no, I could get the fastest cards for the same capacity for less than half that from amazon, and he was like, but if you get in from amazon, you're likely to get a fake. It's amazon for christs sake.

    You said it had physical mechanical damage to the focus ring - simple grounds to reject it. And having taken over 100 photos isn't just 'having a look in the shop'. I call shenanigans. Reject it, give them the chance to replace it with an actual new one or take the cash and go to a reputable dealer.

    Do new cameras have charged batteries?. Would the customer take 100 pictures while having a play with it?

    That's what I thought. I swear the batteries are usually empty. Apparently it was ordered in from another store and that's the only thing that worries me, as who knows how much it was used there?

    I would assume they'd only need to take a few photos. But I'll check it out. If it appears damaged in any way or has taken an excessive amount of photos I won't bother and might just ask if I can get a refund and buy one from amazon. Do you reckon that seems reasonable? It seems to be impossible to get a new version of this camera from any of the Jessops stores.

    Very dodgy indeed. Jessops are in a bit of a bad way - had to take out millions in loans last November. They used to be a public company but things got so bad they had to go private. Now they seem to be wholly owned by Snap Equity - it all seems very slight-of-hand.
