Selling via Amazon, item I sold developed a fault

hi there,

I purchased an electrical item on Amazon in June last year and it turned out that I didnt actually need to use it (BT thing for splitting calls). Id had it for a few months and never even opened it. I didnt think Amazon would take it back after such a long time so I put it on Amazon Martketplace, sold it, making a loss.

The person purchased it from me in November 2006 and has just emailed me to say that they want to return it under the one year warranty?

I didnt know I was offering a warranty?

What do I do now? Do I get the person to send the item back to me, refund them and then get a refund from Amazon? Ive searched their site and cannot find any info on what to do with items that develop a fault months down the line.

    agreed..........on marketplace you will have a "refunds and return" section. refer them to that if needs be. The one year warranty will be from the manufacturer.

  • I agree, I wouldnt do anything!

    Thats the risk you take when buying from an online market place I would have thought.

    personally I wouldnt offer a refund, as you say, you never offered a warrenty, if the buyer wanted that kind of guarantee they should have purchased it elsewhere!
    finally debt free and want to keep it that way!!

    I was just thinking. Usually when you buy something like that, you get a warranty card inside which you fill in a send off. Wondering whether to point him in this direction? Will ignore for now and see what comes of it. I have send an email to Amazon asking them about items that develop a fault as I did buy it from them in the first place. I lost about £8 by selling it on.

    Sounds like a standard response rather than one specific to your enquiry - also it looks like Amazon are treating you as the customer.

    Only you as the party that purchased the goods new from the retailer have rights against the retailer, i.e. Amazon.

    However, you don't have to accept Amazon fobbing you off towards the manufacturer - that is a route additional to your statutory rights not a substitute for it, namely that Amazon must replace or refund your money for the defective goods at your request.

    As far as the person who bought the item from you, it was then second-hand and providing you did not mislead them as to its condition, they have no such rights to expect you to replace or refund their money due to a defect which comes to light some months later (it might be different if they reported it to you immediately).

    Second hand goods do not have to be of merchantable quality or fit for purpose - they must merely not be mis-described.

    You might want to suggest that the person who bought the item contact the manufacturers, but otherwise you have no responsibility for subsequent defects arising. If you wanted to take it back, get it replaced via Amazon then pass it over to the new owner, that's up to you, but sounds like a lot of trouble when you are no longer legally responsible for the item.

    When I advertised the item as "Condition: New
    Seller's comments: unopened brand new, purchased but didnt need" So does that change things?

    I have sent an email to my buyer asking that they consult the manufacturer. I dont have anything on my userid saying that I offer any guarantee or anything. I contact Amazon out of interest to see what their stance is and was going to wait and see what happens next
