I'd stop paying and see what they do to me. If you have your own child at 18 and half, there is no way you should be still contributing to the PWC's household.I'm never offended by debate & opinions. I agree but don't want the CSA to treat me any worse than they have already. They have just admitted liability for messing my case up previously. The independent case examiner (ICE) aid they acted incompetently!! They are paying me compensation (going to sport aid) but it was nice for the little ma to win one against the CSA. If it is proved fraud then they have to pay me back. All this docent disguise i can't see my new granddaughter which saddens me greatly.0 -

Fair enough. I'm sorry you are not allowed to see your daughter/Grandaughter. I could write paragraghs and pages on how I feel the law sides with the Mother where contact is concerned (and I'm female!).

So she's presumably living at home with a baby -and you want to deprive the household for the money you pay to support your child ?
Do you think because she has given birth she no longer needs shelter, food, electricity etc ? Not exactly the poster boy for parents or grandparents are you ?
The OP is looking for a legastive answer and not your moral answer. I don't see a child either and have to pay for it .0 -
Here is my take on it.
She obviously isnt in full time education or on a college course of 12 hours or more. Why should child benefit be payable ? I know my 18 1/2 year old gets child benefit but unsure why as the CSA cant tell me. As long as child benefit is payable then CSA is still payable. I would make my own enquiries with the child benefit office.0 -
Breaks in your child's education or training
You must tell the Child Benefit Office if there is a break to your child's education or training. They need to know so that they can work out whether you can still get Child Benefit. They can usually carry on paying Child Benefit for up to six months if there is a good reason for the break, for example:- your child is ill
- your child is moving from one college to another
- if someone is ill or has died that is close to your child
- your child is pregnant
Your child might not go back into education or training that counts for Child Benefit. If they don't you may have to pay back some of the Child Benefit you got during the break. The amount will depend on when your child decided not to go back.
The Child Benefit Office may be able to pay Child Benefit for longer than six months. This could be if your child is in hospital, residential care or getting medical treatment abroad, and you still spend money on them.

My daughter is 18 1/2 and has left college, she has just had a baby but I have been told that I will have to pay CSA as her mother is still getting child benefit for her! She is getting child benefit for her child!
so we have a situation where the nan is getting child benefit for her daughter who is also getting child benefit for her child. She is not in full time education but i still have to pay £400 a month until she is 19. I checked with DWP who said its true. The CSA told me on 3 occasions it would stop but now have changed their tune. She isn't going to college with her baby and has left but I have to pay according to csa Bolton. Anyone heard of this situation before, haven't minded paying but for a child who is clearly not a child anymore this takes the biscuit. My MP is on the case but I am very confused. Is our law this mad??I made a mistake once, believeing people on the internet were my virtual friends. It won't be a mistake that I make again!0 -
In my chat with the latest gatekeeper at ICE she mentioned that Child Benefit is a major bone of contention and regular issue for them. Where does is say in legislation that where there is child benefit, there is automatically a right to child support? I don't believe it says so anywhere! Personally I would stop paying right away. I dont believe that child benefit is relevant. I do believe that the CSA USE it as an excuse not to make the appropriate decisions.
As for it being wrong of the OP to wish to stop paying £100 a week to support his daughter, who has a child of her own, what a joke. She CHOSE to have a child it is HER responsibity0 -
Thats a good point Nicky about the child benefit.
I got a letter from our friedly bunch at the csa stating that child maintenance was stopping as he is no longer eligble for Child Benefit. It turns out they opened the case back up when PWC phoned them up and complained. I still havent got a letter confiming this.0
