help!! car insurance co has messed up

hi
as mentioned elsewhere, i have recently been involved in a serious road traffic accident through no fault of my own, and spent 12 days in hospital as a result.
came out to find nasty letter from insurance co and would like some help with how to deal with it - it maybe they admit their mistake straight away but i'm not yet strong enough for a fight and would like to know what i can do if they dont back down.
Basically my insurance was due to run out at midnight on March 11th
i renewed my insurance at 16.30 on march 11th
at some point after midnight on the 11th ie in the small hours of the 12th, i had my accident
the letter from my ins co talk about the accident happening on the 11th, and want to charge me an extra £540.00 because i didnt tell them about the accident when i renewed ( would have been tricky since it happened at least 8 hours after the fone call)
so how do i convinvce them when the accident happened?
do i need to pay them any extra money?
what affect will it have on premiums in the future - even though it was not my fault?
what will happen if i cant convince them, dont pay and they cancel the policy?

I'm sure you can convince them; as Al Mac says there will be Police records.
It may affect the renewal premium pending settlement; but that would be the next premium, in your case a whole year away, and it should have been sorted by then, without cost to you.0 -
It will cost you money to get the Police official report on the accident and it probably will not be ready for several weeks anyway.
But you could write to the Police asking them to confirm the date and time of accident. I am sure they would do that for free!
Anyway, the insurance company will get a report eventually from the Police confirming when accident occurred - but again they will have to wait for Police to prepare report.
Even before the Police Report is available I suggest you contact the Accident department of your constabulary and ask who his dealing with your matter. And pass on those details to the insurance company. You may also be able to get a copy of any 999 call before the Police issue their report.
My guess is that someone has made a mistake (like you) by saying in the small hours of the 11th (when they meant the 12th). And the insurance company will also have a record (or even a recording) of when you rang to renew your insurance.
You insurance company appears to accept that you renewed the insurance before renewal became due, otherwise they would not be paying you (you have indiacte on another thread that they are paying you). If they thought the accident not only occurred before the renewal time but before you actually renewed your policy then point out to them the stupidity of their arguement - your car was written off in the accident - what would have been the point of renewing a policy on a car that had just been written off?

Hi - sorry to hear of all these problems.On the proof of when the accident happened was there a report in the local paper confirming the time it happened ? As has already been said you should not have to pay the £540 now as the accident occurred several hours after the policy was due for renewal.
You mentioned a recent speeding offence and as this was before the renewal date your insurance company will expect you to have told them about this and I assume you have already told them.

Try contacting the following people whom deal with companies and disagreements with insurance companies.
Financial Ombudsman Service (FOS).Their address is South Quay Plaza, 183 Marsh Wall, London E14 9SR (telephone 0845 080 1800).
Did you or someone you can contact ring the police or ambulance? Can you check the time on the mobile phone and or statement.The police or Ambulance control will have a recording with the time and date. I am sure if you ask the police, they will give a letter giving the time and date of the accident was reported. Ring and ask the investigating officer, as he will have notes written down.

Many thanks for those replies, initially they were a bit reluctant to change their information but i was able to quote the diff bits mentioned above and they seemed fine .... although i'm not sure i will be totally convinced until i see it in writing!

won't the insurance company get that anyway if you give them the crime reference number?
Also for compensation claims you'd need access to the hospital records which will have the details on..0
