If they have declared as a couple for the purposes of CSA, then her claim for WTC and CTC are assessable i thought....
As long as he is the higher earner, as it becomes a joint claim...!
IF it is NOT a joint claim, then they cannot use the 25% deduction on his income as they are not living together as a couple...!!!
A couple of other things i would point out, if he was on a DEO, then any change over a certain percentage would have to of been notified to the CSA by LAW....!
So make a complaint and get them to investigate when the pay rise was and how much the increase was, it may be possible to get it backdated as a result in his failure... It is worth a try anyway...
I asked about backdating-theyll only do it to the date i rang, even though its his responsibilty to do it. I can go for criminal proceedings that he didnt, but she said it would tke ages. 0 0

why don't you shop her for benefit/tax credit fraud? you have nothing at all to lose on that front, have you? it's anonymous (I believe) so it won't come back to you.0

Do it anyway... The great thing about paper trails, especially employment, is one day, in a few years time, they WILL catch up with him for the undeclared pay raise, and then it WILL be backdated...
It may take years more to get the money, but the point is, the law is there for a reason, and people that evade for personal reasons to make themselves more financially affluent rather than putting there kids 1st as they should really don't deserve any sympathy...!
I have struggled with the CSA working more hours to make ends meet rather than lose my flat for defaulting on my mortgage, and then got a higher assessment for earning more...! It is just not fair...
Keep fighting, and don't let it get you down...!
You still have the knowledge that you did right by your kids, he might say that he does right, but in reality he has only made things worse for himself... 0 0

They dont include her income at all, they have to volunteer the information or so im told. The csa lady said they dont ask anything about her income. Silly girl has been that careless with her details that ive a paper trail from 2008 detailing when they moved it, what her benefits are and what she earns in her business. She also has a husband who is in a care home due to an accident and she got an insurance claim and didnt delclare that either. Im not working at the minute and i cant afford two new cars, a house extension and holiday and feed five kids aswell!!!!! My other half says i should be a detective as nothing gets passed me!! It just doenst seem fair to me, im doing all the work and she has a problem with him paying £50 a week for teenage boys!!!!Im cross-can you tell? x
They won't if it's CSA 2! She can earn £2000 a week and it will make no difference to your ex's assessment, he will only be assessed on his income, CTC and WTC if applicable. Where they will get into trouble is, if they have been living as a couple and claiming means tested benefits as if she was single.
This could be hard to prove though, you say you know, but they could deny it and say they have just moved in together, and you're just being bitter etc. TBH, I'd just concentrate on getting what you are due off him, and let them get on with it. If they carry on it's odds on they'll get caught, especially if he tries to get a "discount" on step kids living with him.0
