    My mp is involved, my solicitor, the head of the csa in my area, still no joy!!!!!! My ex has been very clever as has his girlfriend about the timimg of them 'moving in together' a month ago, yet my kids have been going there since 2008!!!!!!!! Hed rather pay 25% to somebody elses kids than his own!!!! Im shocked!!!

    Why is he paying 25% to someone elses kids and how do you know this? He will only be liable to pay CM for his own children.

    I know becuse the child support agency advise line told me he would be liable to support her children if they were living together as a couple. 5% for each of her children that should have been going to my kids. Hes been living with her since 2008 and having a life as a couple. Shes married and has four kids, one with him. She also claims benefits and hasnt declared my ex was living with her until May!!!!! She is married and her husband is in a home and she has been claiming as a married womn aswell as living with my ex!!!!

    I think you might be getting a bit confused here. He does not pay 25% for his partners kids, what happens is, his wages are assessed for CM for you (which, with 4 kids will be 25%) minus a % for the kids living with him (not sure how much, think it's 25% for that many) So say he earns £1000 pm, then your CM will be assessed on £750 i.e 1000 minus 25%. (I've used round figures as my maths are not up to scratch :D)

    WTC are taken fully into account if he earns the most, half if they earn the same, and not included at all if she is the higher earner. CTC is always taken into account regardless. It's swings and roundabouts really, you only get assessment on 75% of his wage, but you also get her CTC and possibly WTC taken into account.

    The fairer way would be to disregard any step children living there, and assess on full wages, but also disregard their CTC and WTC for her kids as well.

    They only take her benefits into account if they advise them what they get, thats what ive just been told. All theyre basing this on his his income alone, and as for r five years. And as theyve lived together 5 years undeclared i cant see them volunteering. thanks though ill tell my advisor what you said.

    They had better watch themselves then!! If he's living with her and she is claiming means tested benefits as a single mum, then they will be in a whole heap of trouble if they are found out. But that is not your problem if they want to take that risk. Good luck anyway, and be prepared for the long haul! :)

    As long as he is the higher earner, as it becomes a joint claim...!

    IF it is NOT a joint claim, then they cannot use the 25% deduction on his income as they are not living together as a couple...!!!

    A couple of other things i would point out, if he was on a DEO, then any change over a certain percentage would have to of been notified to the CSA by LAW....!

    So make a complaint and get them to investigate when the pay rise was and how much the increase was, it may be possible to get it backdated as a result in his failure... It is worth a try anyway... ;)

    Thanks! Ive been waiting since January still nothing. Ive concrete proof theyve been together since 2008. She has also been postig my private business on the internet since then and passing comments and judgments on my life and my ex husbands relationship with his kids!! He doest see them shes made sure of that, least he can do is pay for them.

    Hi thanks, ive done all that. Shes also working and not declaring it aswell. They dont include her income at all, they have to volunteer the information or so im told. The csa lady said they dont ask anything about her income. Silly girl has been that careless with her details that ive a paper trail from 2008 detailing when they moved it, what her benefits are and what she earns in her business. She also has a husband who is in a care home due to an accident and she got an insurance claim and didnt delclare that either. Im not working at the minute and i cant afford two new cars, a house extension and holiday and feed five kids aswell!!!!! My other half says i should be a detective as nothing gets passed me!! It just doenst seem fair to me, im doing all the work and she has a problem with him paying £50 a week for teenage boys!!!!Im cross-can you tell? x
