Hi.
I hope i have posted this in the right place, in Jan 2012 I informed RBS that I was going to have some difficulties in maintaining payments, and I requested a reduction in my monthly payment, they stated for this to happen, I would have to default on the card, for them to be able to help, so this I did, and the following month (feb 2012)I contacted them again, and set up a payment plan for 6 months, I then received a letter (Apr 2012) informing me that I needed to make payments to keep my debit up to date, I contacted them again and explained that we had made an arrangement,to which they agreed, and again agreed to now honor the 6 months until Sept 2012. this took place on the 6/4/2012 and 19 days later the account was handed over to a collection agency, who contacted me and asked me to set up a payment plan, and to this I informed them I already had one and that I was upholding my end of the deal.:mad:
Sorry to go on, but can they do this with out informing me, as their letter only states that action MAY result in the account being handed over to a collection agency.
I have made regular payments on my card for over 5 years, and the only time I ask for assistance, I have to go into debt before they will talk to me about my issue,
I made an official complaint on the 17/05/2012 about they way I have been treated, and as of yet no letter of acknowledgement ( they did state that they only send out letters 2nd post)
How can I prevent them taking out a CCJ as I believe that I am maintaining my payments

As you have found out they will only reduce payments once you default, but this is still a default if you are making reduced payments. If something may happen consequntially in a contract then it's no surprise when it does happen. With respect to the Payment plan then I suppose their logic is that your situation may change And you can then make additional payments.
Logically you would expect some form of payment to be better than none, but there are stories on here whereby this has only extended or delayed the default. Therefore it may be best to objectively try and determine how long you might be on this payment plan, as this will help you determine how to continue.0
