    You can't really 'demand it' its not the law it's just policy, tesco will prob just say they reserve the right to change their minds at any point
  • Thanks for you comments. I guy I spoke to kept saying 'but the price on the label is correct - it's £3'. I kept saying 'yes, but it also says on the label buy one get 2 free and I didn't get 2 free'.

    Does seem somewhat slippery though!
  • Can I ask a quick question please from a slightly clueless person? I ordered the Fairy online and I wasn't sure if the 3 for £2 would be honored and of course I was charged 2 for £3. I understand that the DTD doesn't apply online but can I get a refund for the overcharge as the offer wasn't honored?

    Not when they have a sign displayed behind the customer service desk. If they refuse, you phone Head Office customer services, or do that anyway if you dont want to go back. If you get the right person on the phone when you explain, they are able to send you out a gift card to cover dtd. HTH

    No once youve got the money off your first order etc it doesnt matter if it drops below this.

    I dot doubt that but what I'm saying is if you didn't get any joy out of HO you couldn't take them to court or anything because legally you don't have a leg to stand on

    Legally you DO have a leg to stand on. The offer Tesco makes forms part of a contract with them. They don't have to sell you the goods in the first place if they don't want to - for example, if the person on the checkout notices a mistake BEFORE she has rung up the item and you have paid, there is no contract and they can legally refuse to sell it to you.

    BUT, once you have paid, the terms of the offer are binding on Tesco and you are entitled to a refund if they've got it wrong.

    You probably wouldn't want to take them to court over £3 or whatever it is, but in theory you would be perfectly entitled to do so.
