NEED HELP regarding warranties

Hello all
I recently brought a R.A.T 9 long story short in 2011 Madcat/cyborg (makers of the R.A.T 9) added a filter to the mouse as it had tracking issues. i brought this mouse 2 days ago to find out after speacking to a USA rep on there live chat serves, that it is a fault and can be replaced for a new one, how ever in the UK the 1st year is covered by the retailer then the 2nd by mad cat. they said if it was in the 2nd year they would just replace it, as its in the 1st year its down to the retailer to replace. but the retailer dose not have any more and can only offer a refund. i do not want a refund as i would have to pay for postage again. then buy a new one from somewhere else, to pay more postage.... to run into the risk of getting the older model again. i jsut want it replaced under warantie by madcat even if its under the 1st year. as its a knowen fault with madcat and they have made modification to newer models shouldn't i be able to send it to them for replacement regardless of year? its a know fault that can't be repaired. where do i stand with this? if it was in the usa they would just replace it but as its uk with are rubbish laws its down to the retailer as i said i do not want a refund as it was of offer for 49.99 when this mouse cost around 90 normaly. and i would have to fork out more postage should i be able to force madcat to replace it.

Despite your belief, the UK has very strong consumer protection laws. That responsibility lies with the retailer rather than the manufacturer does not make the laws 'rubbish'. In a different situation, you might have found yourself wanting a product replaced which was discontinued by a manufacturer, but still in stock at retailers. Swings and roundabouts.
The combination of circumstances in your case is unfortunate. Have you told the manufacturer that the retailer no longer stocks the model, so cannot replace it? I'd try writing a very courteous and polite email to the manufacturer, explaining that the retailer can no longer replace the item and requesting under the circumstances (as you wish to continue using the manufacturer's product), that they might consider replacing the mouse during the first year as a gesture of good will.There's love in this world for everyone. How are the UK trading laws rubbish.
From what you say, the item has now been discontinued themselves or the manufacture. As such the retailer has offered a full refund, so sounds pretty good. Granted it is not what you want to hear but if they can't hold of another one to replace, then not much they can do but offer a full refund.Mansion TV. Avoid at all cost's :j0 -

Just saying, not a condemnation, but your post has glaring spelling & grammatical errors, and should you send such a letter, with similar errors, it will, unfortunately, place you down in the "no chance"

I'm not entirely sure that Madcat can force the retailer to act, if they are offering a two year warranty. Even if they can, a refund is all that is required from the retailer. Although that said the retailer may have underwritten the warranty, thus exhonerating the manufacturer...
As you mention postage, I assume you bought online? Can you not "manipulate" your proof of purchase to say you bought a year earlier, then go back to Madcat?0 -
