Ebay or PayPal rights.... Quick help needed

I bought a fake purse on ebay
Thing is I kinda knew it might be fake as the price was so low but so many people were bidding on it I thought maybe I'm getting a bargin. Slim but I won the auction
Got the purse and the inside is sticky and slightly ripped but pictures of the inside were not shown on the auction and i contacted seller they are not wanting to refund saying they wouldn't have sent it out like that
I know I was silly to believe i would get the real thing but I've learned my lesson!
just wondering what kinda rights do i still have because it was just obvious that it was a fake and i should not have bidded coz the price made it obvious
100% feedback on both parts seller and myself

Thanks

When you send it back, make sure you do so via trackable method
Thrifty Till 50 Then Spend Till the End
You can please some of the people some of the time, all of the people some of the time, some of the people all of the time but you can never please all of the people all of the time
  • DO I still have rights even thought i knew it was most likely a fake?

From a buyers point of view, isn't an ebay dispute better than a paypal one when claiming goods are fake?

I though that with a paypal dispute, the buyer will have to prove that the item is counterfeit, but with an ebay one, the seller must prove it is genuine.

Irrespective of what you thought, it is still illegal to sell counterfeit products in the UK.
Just don't mention your doubts in the dispute process.

    Thanks
I just check the messages back and fourth and I saw a message of me asking the seller if it is real and if the purse was ever made in that style for real
They replied with a 'ah no i don't think so got it when i was away'
    I'm screwed arent i?
I don't know why I did it I know it was silly, I dunno why I believed it might still have been real

If it was purchased on eBay as far as I know you cannot open a PayPal claim but have to go via the ebay resolution center anyway.

You have rights to return goods within 7 working days (with certain exceptions) without having to give a reason (you may be required to pay return postage) - so just go to the eBay resolution center and submit a request to return goods.

You can, and it's quicker to open a paypal dispute. Just open a SNAD and you will get a refund. DSR does not apply to private sellers or auction sales so that is a no go.
You will still have to return the purse for your refund so make sure it a tracked delivery. Both Ebay and paypal make you return fake goods now so paypay has a quicker turn a round.
