Just when I thought I was getting my left back together, things were going better, Capital Finance One this morning started withdrawing money from my current account. I now limit myself to around £450 a month and this morning, my banks fraud department told me of around £125 in single £25 transactions being taken from my account. the bank have put a hold on my account, giving me the change to speak to CFO, but their website doesn't seen to exist anymore and reading reports about how they do not care and refuse any type of payment plan. The thing that concerns me more so is that they never had these card details but yet these were used for the transactions. I need to go and take the money out of my account so I have it to live on, but I know my mobile phone will need to come out at some stage and I think if I get the block removed from my account, I think they will drain it completely. Is there a chance if I unblock it now, that they would have transactions piled up waiting to go and the moment my account is free, they will start clearing? I know I can call my bank and get them to cancel my card but thats 10 days without a card, and I work all the times the banks are open and the nearest one would take over an hour to get to and back during a lunch break. Does anyone know if they will have a back log of transactions that will go through the moment I remove the block or can I have time to get to a cash machine and withdraw my money first? Also does anyone know how to conatct these people as I now believe this to be a massive scam. I've been scammed by many payday loan companies and by a loan company who kept wanting money from me to give me a £3000 loan. I lost complete hope back in September but now the feeling is coming back that I can't get out of this. Any help appreciated.[/QU0

i too have had money taken from my account today i only gave them my card details to verify and they was going to take a pound, then much to my suprise i have had 6 diffrent amounts took off my card today totalling just over 56 quid i am waiting on my bank as they said they may be able to refund my money if the company is found to be rogue trading in the meantime ive had to have my card stopped and in the process of changing my details. In the meantime i have emailed capital finance one, prioty money club or tma loans which seem to be the same saying i have no intention of taking out a loan and they had no rights to take card transaction. WHO EVER READS THIS AND DECIDING ON TAKING OUT ONE WITH ANY OF THEESE COMPANYS THEN DONT I AM JUST GLAD I ONLY HAD FIFTY SUMMAT QUID IN THERE OR COULD OF BEEN WORSE.0

So you stupidly gave your card details because you thought they were going to use it to verift you - what exactly did you expect them to verify?
As to their rights to take the transaction, you gave them that when you agreed to their terms and conditions - you did read the T&Cs before agreeing to them didn't you? If you did then you will know how to get your money back - I'll give you a clue, it's not emailing them or requesting a chargeback from your bank.0 -
i gave them the authority to deduct one pound only not any more the bank explained to me i probably didnt see it in terms and conditions as it is in the tinest small print i cant get it refunded back on my card anyways as i have cancelled it i have emailed requesting a cheque back i doubt i will get a response i guess its a tough lesson learnt .0

No you gave them the authority to take their brokers fee - the T&C will have said that they will initially take a £1 to validate the card, followed by attempting to take the remainder of the money.
It's a pity that you didn't find a magnifying glass or increase the font size so that you could read their T&Cs - then you wouldn't have wasted your money would you.
If I was you in future, keep your debit card in your purse until you are 100% certain why someone is asking you to provide your payment detials (I'll give you a hint - it is usualyl becase they want to take money from you).0 -

Providing you follow the cancellation procedure in the T&C to the letter then your chances are very good - these companies know they are on dodgy ground, so if people follow their procedures they usually refund to avoid the spotlight.
Assuming that you are still within the 14 days that they usually give you and write to the correct address then you should get your money back. If they don't refund and you follow their procedure then you can probably get your bank to do a chargeback (but you will need proof of sending the letter).0 -
good news i went to my bank and i had to fill out a form basically saying that i thought company was in the wrong that i did not understand the terms and conditions and that i thought they had took money without my authority, they refunded my money back at 345pm this afternoon the company still have my bank details but no card details so as soon as my working tax payment ect goes in tuesday i am changing the account number ect and sort code only problem is mine is a basic bank and the new card are not debit cards dont know if i could cope without a debit facilty im going to mull it over wether to do this thanks for replies peeeps. lets say ive learnt a valuble lesson.0

Did your bank tell you how they were processing the refund?
If they are doing a chargeback then the company can contest it on the basis that they provided full T&Cs, which you agreed to. You could well find that in a few days/weeks the money is re-debited when they provide evidence of what you agreed to. Unfortunately by then you will probably be too late to cancel the proper way - so you might be better off sending them a cancellation letter as well before you are too late.0
